Delivery of VMware subscriptions

1. Contract award may be requested by Contractors who meet together the conditions for participation in the procedure concerning technical or professional capacity set by the Contracting Authority. 2. “Technical or professional capacity” The Contractor shall demonstrate that during the last 3 years before the deadline for the submission of tenders, and if the period of business is shorter – during that period, he has duly completed at least 2 (in words: two) contracts, each involving the supply of a subscription to VMware or an equivalent solution, with a value of at least PLN 200 000 gross (if the value of the contract is determined in a currency other than the gold conversion will be based on the average rate of PLN announced by the President of the NBP and applicable on the date of signing the contract for the implementation of the service). 3. Assessing technical or professional capacity, The contracting authority may, at any stage of the procedure, consider that the contractor does not have the required capacity if the contractor has conflicting interests, in particular the involvement of technical or professional resources of the contractor in other economic activities of the contractor may adversely affect the performance of the contract.
