What the buyer wants
The objective of the project is the modernization and digitalization of the public services of the two municipalities through an integrated CityApp-type digital platform, composed of the modules described in Chapter 5. Indicators committed under the financing application: RCO14 - 2 public institutions supported; RCR11 - 4,800 users/year of new and optimized digital services, products, and processes.
The procurement is carried out for the benefit of a partnership consisting of two administrative-territorial units: the Municipality of Odorheiu Secuiesc, as lead partner and contracting authority conducting the procedure, and the Municipality of Gheorgheni, as partner, pursuant to the partnership agreement and the financing contract related to project code SMIS 336969. The solutions subject to this procurement shall be implemented, tested, and piloted across both municipalities.
Both municipalities have the same functional needs; therefore, all modules described in Chapter 5 shall be delivered for each of the two beneficiary administrative-territorial units, without functional differentiation. The Municipality of Gheorgheni is not a party to the public procurement contract. The contract is concluded exclusively between the contracting authority and the designated winning economic operator; invoicing and payment are carried out exclusively to and by the contracting authority. 2.7.2.
Multi-tenant architecture and data isolation The solution must support a multi-tenant architecture, in which each beneficiary municipality has a completely separate environment. Both isolation via distinct virtual machines for each municipality and isolation via distinct namespaces in a container-orchestrated environment, or any equivalent solution that cumulatively fulfills the requirements below, are accepted as compliant options.
- CT-PRT-01: Operational data of one municipality shall not be accessible from the environment of the other municipality. - CT-PRT-02: Each municipality will have its own set of credentials, separate databases, and isolated storage spaces.
- CT-PRT-03: Monitoring is performed separately for each municipality, with individual dashboards and alerts, without cross-environment visibility.
- CT-PRT-04: Backup and restore operations can be performed independently for each municipality, without affecting the environment of the other.
- CT-PRT-05: Artificial intelligence components keep conversational context and knowledge bases strictly separated by municipality (distinct collections and indexes), including when the inference service is shared. 2.7.3. Independent configurability
- CT-PRT-06: Each beneficiary municipality can independently configure, through its own administration interface, at least: local nomenclatures and lists, published content and its categories, indicators, thresholds, and alerts, roles and access rights of its own users, as well as the level of information publishing to citizens, for each module. 2.7.4.Integration with the existing systems of each municipality The two municipalities use different pre-existing IT systems. The integrations required under these technical specifications are those specified in Chapter 6.5 (CT-INT-03 and CT-INT-05), in CT-BI-01, and in the specific module requirements in Chapter 5, and are included in the tendered price.
- CT-PRT-07: The bidder shall develop, during the detailed specifications and GAP-FIT analysis stage (Chapter 8.4), a distinct integration plan for each beneficiary municipality, based on the inventory of existing systems conducted during the same stage, together with personnel designated by each municipality.

The tenderer is required to specify the categories of services it intends to subcontract, as well as the percentage or value related to the activities indicated in the tender as being carried out by subcontractors, and the identification details of the proposed subcontractors, if known, at the time of tender submission.
If the procurement documents require certifications for the provision of services, and the tenderer does not hold the requested certifications and intends, during contract performance, to subcontract the part/parts of the contract for which these are required, and the subcontractor is unknown as of the tender submission deadline, the tenderer is obliged to indicate “YES” in the ESPD under Part IV Selection Criteria => C. Technical and professional capacity => Subcontracting proportion.
If, during the execution of the contract, the tenderer wishes to subcontract a part of the contract, it is mandatory for the tenderer to state “YES” in the ESPD under Part IV Selection Criteria => C. Technical and professional capacity => Subcontracting proportion as of the tender submission deadline. The contractor has the right to involve new subcontractors during contract performance, provided that their nomination does not represent a substantial modification of the public procurement contract.
According to the provisions of Art. 193 of Law 98/2016, the contracting authority will accept, at the time of tender submission from the tenderer, the completed ESPD, which will also include information on the part of the contract to be subcontracted and will have the subcontracting agreement attached.
Subcontractors on whose capacity the tenderer relies will, in turn, complete a separate ESPD, including information regarding exclusion grounds, as referred to in Art. 164, 165, and 167 of Law no. 98/2016, as well as those relevant from the perspective of the capacities on which the tenderer relies. If a qualification requirement is not met through the subcontractor, it will submit the ESPD solely to demonstrate that it does not fall under any grounds for exclusion.
According to the Notification on the use of the ESPD of 08/04/2019 issued by ANAP: “For cases where the tenderer is a consortium of economic operators or where the tenderer has subcontractors or supporting third parties, each economic operator shall log into the system and access the procurement procedure of interest in order to complete the ESPD in the capacity in which it was included in that procedure (associate, subcontractor, supporting third party).
It is necessary that all entities required to respond to the ESPD be registered as system users.
As is currently the case, one of the members of the consortium or the economic operator participating with an individual tender registers for the procedure and submits the tender, while the other participants only complete the ESPD directly in the system and cannot alter the tender.” The economic operator ranked first following the application of the award criterion to the admissible tenders shall prove fulfillment of the qualification requirements through subcontractors by presenting their supporting documents, upon the request of the contracting authority.
The contracting authority may reject the proposed subcontractor if it does not meet the qualification requirements regarding capacity or falls under grounds for exclusion, and may request the candidate/tenderer, only once, to replace it and present another subcontractor.
