The performance is by mind. 4 provide evidence of reference contracts for the main services provided in the last five years and comparable by type and quantity to this call for tenders. Three reference projects must have been delivered by type and scale with comparable technological and organisational complexity in Business Continuity Management (BCM) and IT Service Continuity Management (ITSCM); at least one of the three references must have been implemented on-premise and another with a contracting authority.

These two minimum requirements can also be provided in a reference. It must be demonstrable that expertise in working with BCM/ITSCM consists of project experience. In addition, a reference on successfully conducted training for administrators and users is required, showing that expertise consists in the transfer of theoretical and practical knowledge and in the ability of administrators and users to transfer knowledge. The detailed requirements can be found in Appendix 03 Self-declarations and evidence.

According to § 122 Abs. 2 No. 1 GWB in conjunction with § 44 VgV, the bidder must enclose a commercial register extract or provide proof that the tenderer is registered in the professional or commercial register in accordance with the legislation of the country of the European Community or of a Contracting State to the EEA Agreement in which he is established. One uncertified copy is sufficient. The proof must not be older than 6 months.

Undertakings which are not listed in the professional register, the commercial register or any other register shall provide a copy of the business registration to the competent authority of the country in which they are established or any other appropriate proof of the nature of the professional activity. The envisaged legal form of the companies, or Groupings of tenderers shall be specified:

Turnover of the company in the last three completed financial years. The total turnover of the undertaking and the turnover of the undertaking through services comparable to the service to be awarded shall be reported.

Number of employees from the last three completed financial years. The number of employees of the entire company, as well as the number of employees who are qualified for the service to be provided, must be specified. As a minimum, Appendix 06 Employee Profiles must be completed and submitted with the offer.

The offeror must have company liability insurance to cover property, personal and property damage. The minimum coverage for property and personal injury must be EUR 1,000,000, the minimum coverage for property damage must be EUR 500,000, each per case. The amounts may be capped at twice the value per year of insurance.

The tenderer shall prove this by submitting a proof of insurance valid at the time of submission of the tender or a binding declaration of insurance showing that, in the event of the award of the contract to the tenderer, such insurance will be available for the required amounts of cover. In this case, the contracting entity must prove the existence of the insurance cover immediately after the contract has been awarded.

All communication between AN and AG within the framework of the implementation of the contract is to be conducted verbally and in writing in German. At least the C1 language level is expected (according to the "Common European Framework of Reference for Languages").

According to the specifications in connection with the catalogue of criteria, 7 concepts are submitted (K1 - K7). The submission of these concepts is mandatory. In case of non-submission, the offer is excluded from the rating.

If the bidder is not the manufacturer of the software himself, he must prove that he has an active partner status of the manufacturer and is entitled to distribute the software.
