1. Tenderers or members of groupings must, depending on the legislation of the country in which they are established, either prove their registration in a professional or commercial register of that country or otherwise demonstrate the legal pursuit of the profession (to be provided for each member in the case of groupings). The evidence can be presented as a scan of the original documents. The date of retrieval of trade register extracts submitted must not be older than 6 months from the contract notice.
2. For each subcontractor, at the time of its designation, according to the legislation of the country in which the subcontractor is established, either the entry in a professional or commercial register of that country or in another way the permitted professional practice must be proven. The evidence can be presented as a scan of the original documents. The date of retrieval of trade register extracts submitted must not be older than 6 months from the contract notice.

Tenderers must submit a declaration on the total turnover as well as the turnover in the field of activity of the framework agreement for the last three financial years before the date of publication of the contract notice, if corresponding information in accordance with § 45 Abs. 4 No. 4 VgV are available. Minimum requirement: The tenderer’s turnover in the field of the contract must have been at least EUR 3,000,000 net per financial year for the three financial years preceding the date of publication of the contract notice. The scope of the contract in the above sense is the provision of software from an applicable Microsoft Enterprise Agreement.

(1) It is necessary to provide suitable references of the tenderers regarding previously executed contracts in the form of a list of the essential services provided in the period since 01.11.2023 with indication of the service period and the recipient (reference customer with named contact person as well as his telephone number or e-mail address). Anonymised information shall not be allowed. Incomplete information on a reference is not taken into account.

Requirements which would relate to incomplete or unfulfilled information on a reference shall not take place. Minimum Requirement: At least two references, each of which meets the following minimum conditions and is to be explained in a meaningful manner with regard to this: a Software from a valid Microsoft Enterprise Agreement to a reference customer b for the amount of at least 1,000 licenses c) in the period since 01.11.2023
