What the buyer wants
The objective of the award is a framework agreement on the procurement (purchase, rental or subscription) of standard software, the maintenance associated with the standard software and related services for Dataport’s own / internal needs and the needs for Dataport’s customers / carriers in the context of the commercial business. Standard software is software already developed and not programmed for a single customer. In contrast, individual software, which is not part of this contract, is software to be developed or programmed specifically for a specific customer. The term of this framework agreement begins on 01.01.2027 and has a term of up to 4 years (2 years with two renewal options of 12 months each). The procurement procedure is carried out by Dataport in order to cover its own and customer requirements. In the case of framework agreements, the maximum value to be indicated in the EU notice shall be 150 % of the awarded contract value. This means that the customer will retrieve services from this framework agreement up to a maximum value of 150% of the total offer amount.

Total turnover including turnover in the field of activity of the contract: [Information on turnover (eAllocation Criterion 2.1.2.1.2.1.1, 2.1.2.1.2.1.2, 2.1.2.1.2.1.3)] The query of the turnover figures in the e-procurement must be answered accordingly and, in addition, in the case of a bidding group or the use of privileged subcontractors, the corresponding information for the other companies. The information shall be verified to ensure that the average turnover in the field of activity of the contract for the last three financial years indicated is at least 10 million. euro If this information does not reach the required minimum value, a positive forecast that the tenderer has the necessary economic and financial capacity to perform the contract cannot be made; the offer is then necessarily excluded from the procedure. For groupings of bidders and for the use of privileged subcontractors, the turnover ratios of the members of the grouping of bidders or of the privileged subcontractors and of the bidder shall be added. A tenderer shall be deemed to be capable of performing in this sense only if it meets the minimum criteria of economic and financial capacity. The contracting entity and the contracting entity reserve the right to request further information or evidence from a tenderer at any time in order to verify its information.
References: [Interpretation of the APPENDIX Reference Description] At least one comparable reference project which has been successfully completed in the last three years (from or until the offer deadline) shall be provided. For this purpose, the APPENDIX reference description must be completed in full (possibly several times for naming several reference projects) with the offer. A reference project is then comparable to the object of the contract if it substantially corresponds to the framework conditions resulting from the specification of services (part B of the award documents) (type of service, duration of the contract, technical environment, etc.) and if it covers a comparable order volume of min. €2 million annually. A reference project is deemed to be successfully completed if it ran for at least 6 months after the above-mentioned deadline until the end of the offer period and has now been successfully completed – i.e. not ended early – or if the project is currently still running and has started at least 6 months ago (also counted from or until the offer period) The decisive factor is the end of the tender period. Should the deadlines be postponed, the end of the actual offer period always applies and the above mentioned deadlines are postponed accordingly. If the evaluation of the reference description in accordance with the APPENDIX Reference Description does not make it possible to forecast that the tenderer will perform the contract in a technically sound and timely manner, the performance will be denied and the offer will be excluded from the further evaluation. Only what is explicitly described in the APPENDIX Reference Description Form can be taken into account in the assessment. For groupings of tenderers and for the use of privileged subcontractors, the submitted references shall be considered as a whole. A tenderer shall be deemed to be capable of performing for that purpose only if he fulfils the minimum criteria of technical and professional capacity. Information on qualified personnel: [Evaluation of the information on qualified personnel (eAlert Kriteri-um 2.1.2.2.2.2.1)] The tenderer shall enter the required information on qualified personnel in the eProcurement section of the selection criteria under item 2.1.2.2.2.2.1 eProcurement criterion ‘Qualified Personnel’. The information is checked to see if the bidder has the following specialists who are to be used in connection with the provision of services (minimum requirements): 1 dedicated contact person for the customer’s support in external sales This contact person is the first point of contact for questions about products, contracts, rights of use. The services are generally provided remotely. An on-site presence only takes place if it is absolutely necessary for the provision of services. The dates are agreed by mutual agreement between the client and the contractor. The contact person takes over the following activities: o Coordination of offers and price enquiries o Answering questions about licensing and contracts o Answering questions about technologies o Qualification of enquiries o Ensuring that the correct articles/solutions are offered on the basis of the enquiries o Communication with the client and dataports carriers/customers o Communication with manufacturers in the sense of the client o Preparation and follow-up of meetings with the client, carriers/customers, manufacturers o Casual information dates about the framework contract and contract status o Advice and technical support with the upcoming renewables o Contact person in the event of escalations • 1 Representative of the dedicated contact person for the support of the client in external sales • 1 dedicated contact person for the support of the client in internal sales This contact person is remotely available for quotation requests, licensing questions, contract questions, order processing, preparation of offers and price information. The contact person assumes the following activities: o Coordination and creation of offers and price information o Answering questions about licensing and contracts o Qualification of requests for offers o Ensuring that the correct articles/solutions are offered on the basis of inquiries o Communication with manufacturers in the sense of the client o Advice on the proactive renewable offers o Casual participation in meetings remotely. An on-site presence only takes place if it is absolutely necessary for the provision of services and after prior coordination between the client and the contractor. • 1 Representative of the dedicated contact person for the support of the client in internal sales In the case of consortia of bidders and the use of privileged subcontractors, the information is to be provided for the company(s) and the proof is to be submitted by the company(s) which will perform the relevant part(s) of the service. If the required explanation is not available or it is not possible to make a positive forecast that the tenderer has the necessary technical and professional capacity to perform the contract; the offer is then necessarily excluded from the procedure. A tenderer shall be deemed to be capable of performing for that purpose only if he fulfils the minimum criteria of technical and professional capacity. The contracting entity and the contracting entity reserve the right to request further information or evidence from a tenderer at any time in order to verify its information.
Environmental Management Quality Assurance Measures: [Information on Environmental Management Quality Assurance (eAuthority Kriteri-um 2.1.2.2.2.3.1)] Evaluation of the information on quality assurance in the area of environmental management (eAssignment Criterion 2.1.2.2.2.3.1) or evaluation of the installation for quality assurance environmental management (the submission of the installation is only necessary if no certificate is available, but general and comparable to the standard of the certificates quality measures are implemented for all business processes). The measures shall be described in the Appendix and submitted together with the tender. In the eAssignment Criterion Quality Assurance Environmental Management, the necessary information must be provided. The information on "quality assurance" is checked to see if the company has a valid certificate in accordance with EMAS or DIN EN ISO 14001:2015 (or later) or equivalent (self-declaration in the eAssignment and submission of the corresponding certificate) • or a comparable environmental management system (in this case the submission of the "quality assurance environmental management" system is required). In the case of consortia of bidders and in the case of the use of privileged subcontractors, the installation/proof must be submitted by the company(s) which will perform the relevant part(s) for which the environmental management is required. If the required certificate is not available, a positive forecast that the tenderer has the necessary technical and professional capacity to perform the contract cannot be made; the offer is then necessarily excluded from the procedure.
