Economic operators (bidders / associates / subcontractors) submitting the tender must prove a form of registration under the law of the country of residence, show that the economic operator is legally constituted, that he is not in any of the situations of annulment of the constitution and that he has the professional ability to perform the activities covered by the contract. The information contained in this document will be real / current at the time of the presentation. Note 1: For foreign legal entities, edifying documents proving a form of registration in accordance with the legal provisions of the country in which the economic operator is established shall be submitted, showing the information requested by the Contracting Authority. Note 2. If the tender is submitted by an association, the requirement for the object of the activity must be met by each associate for the part of the contract he performs. Note 3. In the case of subcontractors the requirement for the object of activity must be met for the part of the contract they perform. How to demonstrate compliance with the requirements: The DUAE shall be supplemented by all economic operators participating in the award procedure with information related to their situation. The supporting documents proving the fulfilment of those assumed by the completion of the DUAE, namely a certificate of establishment issued by the ONRC, or in the case of foreign bidders equivalent documents issued in the country of residence, shall be submitted, at the request of the contracting authority, only by the tenderer ranked 1st after the application of the award criterion to admissible tenders.

For service contracts: The tenderer must prove that in the last 3 years, calculated up to the limit date for the submission of offers, he has provided similar services carried out, in aggregate value of at least 45,000,000 lei without VAT at the level of MAXIM 3 contracts. Similar services include the provision of the following activities: 1.Software development and implementation services SI / OR 2.Services for the implementation of an IT solution SI / OR 3.Services for the development and implementation of an IT system. Services carried out are understood as: a) services partially received, provided that the specific nature of the contract / activities representing similar experience allows the development of a delivery that can be used by the beneficiary as an independent result b) services received at the end of the provision of services Documents by which economic operators can meet the requirement for similar experience are the following, not limited to: - recommendations - minutes of receipt - certification of good performance - certificates of record, etc. The documents listed above are not cumulative. DUAE shall be completed by the economic operators participating in the award procedure with information relating to their situation. In order to meet the requirement, the DUAE shall be completed, explicitly indicating, for each contract submitted, at least the following information necessary to verify how the criterion is met: the number and date of the contract invoked as similar experience, its beneficiary and its contract data, the quality of the contract (single contractor, associate, subcontractor) the date and number of the receipt document, as well as the weight and / or activities for which it was responsible, specifying the value of the contract, without VAT. The supporting documents proving the fulfilment of those assumed by the completion of the DUAE are to be submitted, at the request of the AC, only by the tenderer ranked 1st after application of the award criterion on admissible tenders At the request of AC, relevant parts of contracts, recommendations / certifications / finding documents, etc. issued or countersigned by the beneficiary will be presented, containing values, periods of supply, beneficiaries, whether they are AC or private clients Note 1) For the calculation of equivalence, the average annual rate of lei / currencies for each year shall apply to the average reference rate established by the NBR for that year. 2) The number of years required to demonstrate similar experience will be calculated by reference to the closing date for submission of tenders. If the deadline is extended, the lower limit of the 3-year period shall be extended by the time period related to the gap, to be considered to be met by the requirement for all operators who have submitted proof that the similar experience contract has been concluded within the new period of time. 3) If a group of economic operators submits a joint offer, the requirement shall be demonstrated by taking into account the resources of all members of the group. 4) In the event that the economic operator presenting that experience has carried out activities as a subcontractor in the contract presented as similar experience for a general entrepreneur, the condition is that those activities are confirmed by the general contractor and the final beneficiary has attested that the economic operator was subcontractor - as required by the Instructions no.2 / 2017. 5) The contracting authority shall have the right to address including the final beneficiary of the services covered by the contract submitted as similar experience to confirm those submitted by the tenderer. 6) In order to meet the requirement, the tenderer may benefit from the support of a third party.

Economic operators participating in the procedure should submit information on SUBCONTRACTIONS (if applicable). Where the tenderer intends to subcontract part / parts of the contract, it shall include in his tender the names of the subcontractors and their identification data, the part / parts of the contract to be fulfilled by them, the percentage of subcontracting in relation to the total amount offered and the agreement of the subcontractors on these matters. The liability of the contractor with regard to the performance of the public contract is not diminished if part / parts of the contract are fulfilled by subcontractors. The subcontractor / subcontractors must not be in the situation which determines the exclusion from the award procedure, as provided for in Article 164, Article 165, Article 167 of Law no. 98 / 2016. How to demonstrate compliance with the requirements: DUAE shall be completed by the economic operators participating in the award procedure with information relating to their situation. With the submission of the DUAE the tenderers will present the agreement / subcontracting agreements signed and stamped by each party, concluded between the future contractor and the subcontractors nominated in the tender. The material and human resources of the declared subcontractors will be taken into account if relevant documents are presented for their part of the contract to be performed. The contracting authority shall, upon conclusion of the public procurement contract, require the submission of subcontracting contracts. The contracts submitted must be in accordance with the tender and subcontracting agreements presented in the tender, which will be set out in the annexes to the public procurement contract.

The tenderer shall demonstrate that it complies with the quality assurance standards, i.e. ISO 9001 certification or equivalent, for the main activity / activities of the contract for the part of the contract it performs. Method of delivery: In order to meet the requirement, the tenderer will complete the DUAE - Part IV "Selection criteria" - Section D "Quality assurance systems and environmental management standards" - subsection "Certificates issued by independent bodies on quality assurance standards." The highest bidder after the award criterion shall submit, prior to the award of the contract, at the request of the Contracting Authority, Certificate / e granted by independent bodies attesting compliance with the quality assurance standards, namely ISO 9001 or equivalent, for the main activity / activities / e of the contract or other evidence / evidence, in so far as the evidence / evidence submitted confirms that the quality assurance is equivalent to that required in the award documentation. Note 1: If a group of economic operators submits a joint offer, the requirement shall be demonstrated individually by each individual member for the part of the contract they make. Note 2: The ISO 9001 or equivalent certification requirement cannot be met through another person (supporting third party). Note 3: If the economic operator demonstrates that it does not have access to a quality certificate or has not been able to obtain it until the presentation of the document, for reasons which are not attributable to it, the tenderer may submit any other evidence or evidence, in so far as the evidence / evidence submitted confirms that the quality is ensured, equivalent to that required by the award documentation.
