Economic operators submitting tenders must prove a form of registration under the law of the resident country, showing that the economic operator is legally constituted, that he is not in any of the situations of annulment of the constitution, and that he has the professional capacity to carry out the activities covered by the public contract. The requirement shall also apply to the partner, the supporting third party, as appropriate, for the part of the contract they are to undertake, which will supplement the information related to their situation at the level of a separate DUAE. Method of implementation: The DUAE will be supplemented by economic operators participating in the procurement procedure with the information requested by the contracting authority - information on the fulfilment of the requirements for the ability to pursue the professional activity. The supporting document proving the fulfilment of those assumed by the completion of the DUAE, i.e. the finding certificate issued by the ONRC, or in the case of foreign legal / natural tenderers, the equivalent documents issued in the country of residence, translated into Romanian, are to be submitted, at the request of the Contracting Authorities, only by the highest bidder in the ranking drawn up after application of the award criterion / by the selected tenderer to sign the framework contract.

The tenderers must demonstrate that during the last 3 years they have supplied products covered by the procedure or a list of similar or higher products. Method of implementation: The tenderers must demonstrate that over the last 3 years (the reference date for the calculation of the period being the date of publication of the contract notice, as referred to in Article 13 (1) (a) of the Instruction of the President of ANAP No 2 / 2017) have supplied products similar to those covered by the framework agreement, without imposing a value threshold by one or more supply contracts produced, at least: The supplies of products shall be confirmed by the presentation of certificates / documents issued or countersigned by an authority or by the beneficiary customer, attesting the experience of delivering at least the estimated quantity for the largest subsequent contract on each lot, as follows: Product Cant. At DUAE level, information should be specified such as: the number and date of the contract invoked as a similar experience, the type (s) of products, the quantity of products, the delivery period, the date and number of the receipt document, beneficiaries, whether they are contracting authorities or private customers. Supporting documents proving the fulfilment of those assumed by the completion of the DUAE - Copies of supply contracts, acceptance minutes or other documents (assumed by the beneficiary) showing the following information: the beneficiary, period and place of delivery, quantity and type (s) of products invoked as similar experience, recommendations, finding documents, other equivalent documents and to be submitted, at the request of the contracting authority, only by the tenderer ranked 1st in the intermediate ranking drawn up at the end of the final electronic auction phase. In application of the provisions of Article 31 (3) of H.G. No 395 / 2016, as amended and supplemented, if a group of economic operators submits a joint offer, then the technical and professional capacity shall be demonstrated by taking into account the cumulative resources of all members of the group. Similar products mean produced by a complexity comparable to those covered by the lot offered. The presentation of similar or superior products in terms of complexity and / or purpose is accepted.

The part / parts of the contract that the economic operator intends to subcontract pursuant to Article 179 (K) of Law No 98 / 2016 on public procurement, as amended and supplemented. Method of implementation: The DUAE shall be completed by the economic operators participating in the award procedure with the information related to their situation. With the submission of the DUAE all tenderers will submit the subcontracting agreement. The supporting documents proving the fulfilment of those assumed by the completion of the DUAE shall be submitted, at the request of the contracting authority, only by the tenderer ranked 1st in the intermediate ranking drawn up at the end of the final electronic auction phase. The supply activity cannot be subcontracted according to Article 3 paragraph (1) letter yy) of Law No 98 / 2016, with subsequent amendments and additions, i.e. only service provision activities (e.g. transport, technical support, service, other activities), ancillary operations related to supply may be subcontracted.
