Economic operators submitting the offer must prove a form of registration under the conditions of the law of the country of residence, from which to reiterate that the economic operator is legally constituted, that it is not in any of the situations of cancellation of the constitution and that it has the professional ability to perform the activities covered by the contract. Method of fulfilment of the requirement: the DUAE will be completed by the economic operators participating in the award procedure (tenderer / associate bidder / subcontractors) with information related to their situation. Filling the DUAE will be done in SEAP directly after authentication in the system and accessing this procedure by each participant. The highest bidder after the ranking has been drawn up upon completion of the evaluation of the tenders, following the application of the award criterion, will submit, before the award of the public acquisition contract, within the meaning of Article 196 of the Law no.98 / 2016, at the request of the contracting authority, updated supporting documents demonstrating the fulfilment of the qualification criteria, in accordance with the information contained in the DUAE. These supporting documents may be: -Note certificate issued by ONRC, resulting at least information related to the shareholder structure, legal representatives, activity object, branches and secondary offices, working points. The information submitted must be real / actual at the date of its presentation. The finding documents must attest that the object of the contract has the correspondence in the activity of the tenderer / associate tenderer / subcontractor, for their part of the contract involvement. In the case of documents issued by the official institutions / bodies empowered to do so, these documents must be signed and initialled according to the legal provisions. The documents will be submitted scanned so that they are legible, and will be signed with the extended electronic signature, in accordance with Article 60, paragraph (4) of GD no.395 / 2016. For foreign economic operators: The tenderer shall present relevant documents proving the form of registration and, where appropriate, certification or professional membership, in accordance with the legal requirements in the country where the economic operator is established, from which to repeat the information requested by the contracting authority. The information submitted must be real / actual at the time of their presentation. In the case of documents issued by the official institutions / bodies empowered to do so, these documents must be signed and initialled according to the legal provisions. The documents will be submitted scanned so that they are legible, and will be signed with the extended electronic signature, in accordance with Article 60, paragraph (4) of GD no.395 / 2016. Documents issued in another language than Romanian must be accompanied by certified translation in Romanian. The following documents shall be submitted with the DUAE: subcontracting agreement and / or association agreement, as appropriate. According to the provisions of art. 55, paragraph (1) of Law no. 98 / 2016, the tenderer shall specify in the tender: a) the categories of contract services he intends to subcontract, as well as the percentage or value of the activities indicated in the offer as being performed by subcontractors; and b) the identification data of the proposed subcontractors, if the latter are known at the time of submission of the offer.
