Method of demonstrating fulfillment of the requirement: Regarding the completion of the ESPD: the contracting authority (CA) has enabled the α (alpha) option in Part IV: Selection criteria. The economic operator (EO) will limit itself to completing field α (alpha) in the ESPD – global indication for all selection criteria. Completion of the ESPD by the tenderer/associate and separately by the third-party guarantor under the Selection Criteria section, item A: Global indication for all selection criteria, where the following text will be displayed: "Regarding the selection criteria, the CA requires the EO to declare that IT MEETS ALL THE IMPOSED SELECTION CRITERIA INDICATED IN THE RELEVANT NOTICE OR IN THE PROCUREMENT DOCUMENTS MENTIONED IN THE NOTICE." by selecting either YES or NO, without having to complete any other section in Part IV. Supporting documents proving the fulfillment of the commitments made by completing the ESPD, namely the Trade Register Certificate issued by the National Trade Register Office or, for foreign legal entities, conclusive documents proving a form of registration as a legal entity or of registration/certification or professional membership in the country where the tenderer is resident, shall be submitted, at the request of the contracting authority, only by the tenderer ranked first in the intermediate ranking. Submitted documents must be true/current at the time of submission. Documents issued in a language other than Romanian must be submitted accompanied by an authorized translation into Romanian.

In the event that a tenderer participates in multiple lots, the qualification requirement regarding similar experience will be considered fulfilled for all lots for which it has submitted a tender if it meets the qualification requirements regarding similar experience set out in the procurement documentation for the lot for which this requirement had the highest value threshold. Method of fulfillment: Regarding the completion of the ESPD: the contracting authority (CA) has activated the α (alpha) option in section Part IV: Selection criteria. The economic operator (EO) shall limit itself to completing the α (alpha) field in the ESPD – global indication for all selection criteria. Completion of the ESPD by the tenderer/associate and separately by the supporting third party in the Selection criteria section, point A: Global indication for all selection criteria, where the following text will be displayed: "Concerning the selection criteria, the CA requires the EO to declare that IT MEETS ALL THE REQUIRED SELECTION CRITERIA INDICATED IN THE RELEVANT NOTICE OR IN THE PROCUREMENT DOCUMENTS REFERRED TO IN THE NOTICE." by selecting one of the options YES or NO, without having to complete any other section in Part IV. The following will be requested as supporting documents: relevant supporting documents: certificates/documents issued or countersigned by the contracting authorities or private clients, suppliers of the products, such as quantitative and qualitative acceptance reports, recommendations, certifying certificates, or any other equivalent conclusive documents attesting to the actual supply of the products, whose value, excluding VAT, is at least equal to the minimum required value threshold. To demonstrate its supply capacity, the tenderer must provide proof that these products have been accepted. Documents issued in a language other than Romanian shall be accompanied by certified translations into Romanian. If the tenderer demonstrates fulfillment of the minimum requirement regarding similar experience by invoking the support granted by another person, pursuant to the provisions of Art. 182 of Law no. 98/2016, as amended and supplemented, it shall be deemed qualified if the supporting third party demonstrates fulfillment of the requested minimum requirement by submitting the relevant documents. At the same time, in this case, it is mandatory to submit the firm commitment of the respective supporting person, as well as the documents transmitted to the tenderer by the supporting third party, showing the actual manner in which the supporting third party will ensure the fulfillment of its own support commitment, documents which will constitute annexes to the respective commitment. If the tenderer is a group of economic operators, the minimum requirement regarding similar experience is demonstrated by taking into account the resources of all group members. If the group of economic operators demonstrates fulfillment of the minimum requirement regarding similar experience by invoking the support granted by a third party, the method of fulfilling the requirement is similar to that for the individual tender mentioned above, with the clarification that support will be granted to the consortium and not to one of the associates. Failure to submit together with the tender the ESPD completed by the supporting third party or its firm commitment will result in the rejection of the tender in question as unacceptable.

According to legal provisions, the supply activity cannot be subcontracted; this provision is applicable only in the case of services and works related to the main supply activity that are to be subcontracted. If the tenderer intends to subcontract part/parts of the contract, the fulfillment of capacity criteria, as well as the non-applicability of the grounds for exclusion provided for in Articles 164, 165, and 167 of Law 98/2016 on public procurement, must also be demonstrated for the subcontractor. If the tenderer relies on the capabilities of the subcontractor to fulfill the minimum requirements regarding economic and financial capacity and/or technical and/or professional capacity, it is considered qualified if the subcontractor demonstrates fulfillment of the required minimum requirements by submitting the relevant documents.
