For supply contracts: delivery of the specified type. In the case of an association, the minimum requirements shall be considered to be met cumulatively. The non-submission of DUAE with the offer (including for the partner / third supporter) attracts its rejection as unacceptable. 2. The supporting documents proposing the fulfilment of those assumed by the completion of the DUAE and to be submitted, at the request of the contracting authority, only by the highest bidder after the application of the award criterion, until the date of conclusion of the award report, according to Article 196 para. (2) of the Law no. 98 / 2016 on public procurement, are documents resulting from values, supply periods and beneficiaries, whether the latter are contracting authorities or private customers; the values will be expressed in lei, without VAT. Examples of supporting documents: copies of relevant parts of the contracts performed, teaching / receiving certificates, recommendations, reception PV, finding documents (see Instruction no. 2 of 19 April 2017 issued by ANAP). 3. Any document issued in other than Romanian will be accompanied by the authorized translation into Romanian. This heading shall only be filled in by the tenderer if it intends to subcontract part / parts of the contract. The subcontractor is required to complete the DUAE separately. If the tenderer intends to subcontract part / parts of the contract, the DUAE will also include information on the part of the contract it intends to subcontract, as well as the percentage or value of the activities indicated in the tender as being performed by the subcontractors. It will also have the subcontracting agreement attached. Subcontractors on whose capacity the tenderer / candidate is based shall, in turn, complement the separate DUAE, including all the information referred to in Article 193 (1) (a), and those of Article 193 (1) (b) and (c) which are relevant in terms of the capacities of the subcontractors on which the tenderer / candidate is based under the award procedure. In the case of subcontractors on whose capacity the tenderer / candidate is not based, the DUAE shall contain only the information referred to in Article 193 (1) (a).

I. Economic operators (including associations, subcontractors, third parties) submitting tenders must prove a form of registration under the law of the country of residence, that they are legally constituted and that they are not in any of the situations of annulment of the constitution, and that they have the professional capacity to perform the activities covered by the contract. The ability to exercise professional activity must be demonstrated by any economic operator participating in the procedure, irrespective of whether it is an individual bidder, member of an association, subcontractor or supporting third party. Method of execution: the DUAE shall be completed in accordance with the provisions of Art. 193 para. (1) of Law No 98 / 2016, taking into account also the guidance provided in the Notification of the National Agency for Public Procurement (ANAP) on the use of the DUAE in procedures conducted exclusively by electronic means from 08.04.2019. The documents to be submitted for the fulfilment of the qualification criterion, at the request of the contracting authority, only by the highest bidder, after the award criterion has been applied, until the date of conclusion of the award report, according to Article 196 paragraph (2) of Law no. 98 / 2016 on public procurement, are: 1. Romanian legal / physical persons: the finding certificate issued by the Office of the Trade Register (ONRC) from the competent court, signed electronically by the legal representative showing that the object of the tender includes the supply of the products covered by the acquisition. The information contained in the certificate shall conform to the reality at the date of submission of the document. Each associate shall be required to submit these documents for the part of the contract to be carried out. Where the economic operator subcontracts part / parts of the contract, the subcontractor shall submit these documents to the part / parts of the contract that he / she has to carry out. 2. Foreign legal / natural persons: equivalent documents, in the country of residence, proving a form of registration or professional membership (the documents will be signed by the legal representative and will be accompanied by an authorized translation into Romanian), in accordance with the legal provisions of the country of residence. Each economic operator participating in the procedure, regardless of whether it is an individual tenderer, member of an association, subcontractor or supporting third party, shall be obliged to submit this document for the part of the contract to be carried out.
