Method of fulfillment: The ESPD shall be completed in accordance with Art. 193 para. (1) and para. (6) of Law no. 98/2016, namely Part IV of the ESPD shall be completed by selecting YES or NO, with the option «α: global indication for all selection criteria» activated. The supporting documents proving the fulfillment of the commitments undertaken through the completion of the ESPD—namely, the trade register certificate issued by the ONRC, or in the case of foreign legal/natural persons as tenderers, equivalent documents issued in the country of residence, translated into Romanian—are to be submitted, at the request of the Contracting Authority, only by the tenderer ranked first upon completion of the tender evaluation. The Trade Register Certificate issued by the National Trade Register Office attached to the Territorial Tribunal must reflect the following information: identification details of the economic operator, shareholders/associates, management bodies, directors, members of the Board of Directors, members of the Supervisory Board, shareholding percentages, as well as the fact that the main/secondary activity carried out, according to the CAEN (NACE) classification, corresponds to the subject matter of the contract. For foreign legal entities, conclusive documents proving a form of registration in accordance with the legal provisions of the country where the tenderer is established shall be submitted, showing the information requested by the Contracting Authority. Note 1: the requirement also applies to associated tenderers, subcontractors, third-party supporting entities, etc., which complete the information related to their situation in a separate ESPD. Note 2: the information contained in the certificate of status must be true/up to date at the time of its submission.
