What the buyer wants

Planning, construction and operation of a gigabit network in the economic gap model of all tendered addresses based on the Gigabit-RL 2.0. The subject of this selection procedure is the award of a service concession for the planning, establishment and operation of a gigabit network in the economic gap model according to Section 3.1 of the Gigabit-RL 2.0. The objective of this measure is to provide the Gigabit coverage of the deployed areas with gigabit-capable broadband connections with data transmission rates of at least 1 Gbit/s symmetrical to peak load time conditions for all end-users of the advertised addresses in the deployed area, with up and download rates at least doubling. The development area results in detail from "B-Service Description" and its annexes, in particular the maps for the development area (B1, B1.1 to B1.2) and the address lists (B2, B2.1 to B2.2). Reference is made to the details of the supplementary documents of this selection procedure (see listing in "A-General Procedure Conditions" Section). 4); thereafter, in particular: (a) Technology neutrality The grantor clarifies that this selection procedure of the Gigabit network to be built and operated with bandwidths of at least 1 Gbit/s symmetrical to peak load time conditions is technology neutral in accordance with point 117 of the State Aid Guidelines EU2023/C 26/01 (point 5.2.4.1, 5.2.4.2) and § 5 para. 7 Gigabit-RR 2.0, consequently the designation selected here such as “Gigabit network”, the designation of the network levels, etc., the representation of the network structure and definition of the material concept 5.0.2, item 5. 2, page 5 f., but this can be viewed analogously when using other technologies for the expansion and operation of the gigabit network. b The purpose of Gigabit-RL 2.0 is to support an effective and technology-neutral gigabit expansion to achieve an ecologically sustainable, secure and high-performance gigabit network in underserved areas. The successful tenderer shall plan, construct and operate a gigabit network in the development area with the defined minimum bandwidths under peak load time conditions. This includes both the necessary passive network infrastructure (e.g. civil engineering services, empty pipes with cables as well as associated components including shafts, distributors, house connections and network termination equipment) and active technology for network operation. Subject to the consent of the landowners, the construction of wired gigabit networks in question in this selection procedure refers to all power supplies, including network termination in the building of each advertised address. In addition, reference is made to the specifications of the “B performance description” including their installations. c) The Gigabit networking and its operation must take into account all contents and requirements of the Gigabit-RR 2.0, the Gigabit-RL 2.0, the decision on a provisional grant as well as its associated ancillary provisions (BNBest-Gigabit), material concept and requirements for the dimensioning of passive infrastructure etc. in the version on which this is based. Reference is additionally made to the applicable legal bases in the plant set "Subsidy law legal bases" (A2).

Verhandlungsverfahren mit Teilnahmewettbewerb entsprechend § 12 KonzVgV i.V.m. § 14 Abs. 2, Abs. 3 Nr. 2, Nr. 3 VgV, § 119 Abs. 5 GWB (zweistufiges Verhandlungsverfahren) zur Bestimmung eines Netzbetreibers für die Planung, die Errichtung und den Betrieb eines Gigabit-Netzes im Wirtschaftlichkeitslückenmodell in den ausgeschriebenen Ausbaugebieten nach Maßgabe der Richtlinie "Förderung zur Unterstützung des Gigabitausbau der Telekommunikationsnetze in der Bundesrepublik Deutschland" vom 31.03.2023 in der Fassung der 2. Änderung vom 13.01.2025 (nachfolgend Gigabit-RL 2.0) sowie die Mitteilung der Europäischen Union "Leitlinien für staatliche Beihilfen zur Förderung von Breitbandnetzen" vom 31.01.2023 (2023/C 36/01).
