The subject of this selection procedure is the award of a service concession for the planning, establishment and operation of a gigabit network in the economic gap model according to Section 3.1 of the Gigabit-RL 2.0. The objective of this measure is to provide the Gigabit coverage of the deployed areas with gigabit-capable broadband connections with data transmission rates of at least 1 Gbit/s symmetrical to peak load time conditions for all end-users of the advertised addresses in the deployed area, with up and download rates at least doubling. The successful tenderer shall plan, establish and operate a gigabit network in the development area with the defined minimum bandwidths under peak load time conditions. This includes the necessary passive network infrastructure (e.g. civil engineering services, empty pipes with cables as well as associated components including shafts, distributors, house connections and network termination equipment) as well as the active technology for network operation. Subject to the agreement of the landowners, the construction of wired gigabit networks in question in this selection procedure shall apply to all power supplies, including network termination in the building of each advertised address. In addition, reference is made to the specifications of the “B performance description” including their installations. c) The Gigabit networking and its operation must take into account all contents and requirements of the Gigabit-RR 2.0, the Gigabit-RL 2.0, the decision on a provisional grant as well as its associated ancillary provisions (BNBest-Gigabit), material concept and requirements for the dimensioning of passive infrastructure etc. in the version on which this is based. Verhandlungsverfahren mit Teilnahmewettbewerb entsprechend § 12 KonzVgV i.V.m. § 14 Abs. 2, Abs. 3 Nr. 2, Nr. 3 VgV, § 119 Abs. 5 GWB (zweistufiges Verhandlungsverfahren) zur Bestimmung eines Netzbetreibers für die Planung, die Errichtung und den Betrieb eines Gigabit-Netzes im Wirtschaftlichkeitslückenmodell in den ausgeschriebenen Ausbaugebieten nach Maßgabe der Richtlinie "Förderung zur Unterstützung des Gigabitausbau der Telekommunikationsnetze in der Bundesrepublik Deutschland" vom 31.03.2023 in der Fassung der 2. Änderung vom 13.01.2025 (nachfolgend "Gigabit-RL 2.0"). Aufgrund gegebener Grenznähe nimmt der Konzessionsgeber Binnenmarktrelevanz an und führt das Auswahlverfahren europaweit durch, obwohl der Schwellenwert nach § 106 GWB nicht erreicht oder überschritten wird. Wesentliche Grundlage des Verfahrens sind die "Rahmenregelung der Bundesrepublik Deutschland zur Unterstützung des flächendeckenden Aufbaus von Gigabitnetzen" vom 01.08.2024 (nachfolgend "Gigabit-RR 2.0"), die Richtlinie "Förderung zur Unterstützung des Gigabitausbaus der Telekommunikationsnetze in der Bundesrepublik Deutschland" vom 31.03.2023 in der Fas- sung der 2. Änderung vom 13.01.2025 (nachfolgend Gigabit-RL 2.0) sowie die Mitteilung der Europäischen Union "Leitlinien für staatliche Beihilfen zur Förderung von Breitbandnetzen" vom 31.01.2023 (2023/C 36/01). Die ausgeschriebenen Adressen des Erschließungsgebietes sind nach Ergebnis der Markterkundung förderfähige unterversorgte Adressen im Sinne der Gigabit-RL 2.0. Aus diesem Grund soll dort auf Basis dieses Auswahlverfahrens ein Gigabit-Netz als technologieneutrale Netzbezeichnung (Netz mit einer Breitbandversorgung von mindestens 1 Gbit/s symmetrisch zu Spitzenlastzeitbedingungen für alle Endnutzer der ausgeschriebenen Adressen) in den unterversorgten Gebieten errichtet werden, wobei sich die Up- und Downloadraten mindestens verdoppeln müssen. Auf die Vorgaben der "B-Leistungsbeschreibung" inkl. deren Anlagen wird ergänzend verwiesen. Der Konzessionsgeber ordnet den ausgeschriebenen "Vertrag über die Weiterleitung von Zuwendungen im Rahmen des Gigabitausbaus in der Stadt Trostberg zum Zwecke der Planung, der Errichtung und des Betriebs eines gigabitfähigen Breitbandnetzes im Wirtschaftlichkeitslückenmodell nach der Richtlinie "Förderung zur Unterstützung des Gigabitausbaus der Telekommunikationsnetze in der Bundesrepublik Deutschland - Gigabit-Richtlinie des Bundes 2.0 (Gigabit-RL 2.0)" als eine Dienstleistungskonzession i.S.d. § 105 Abs. 1 Nr. 2 GWB ein. Der Konzessionsgeber überträgt damit die ihm als Aufgabe der Daseinsvorsorge obliegende Realisierung der Versorgung der Bevölkerung mit Gigabitanschlüssen auf den Konzessionsnehmer, welcher das Nutzungsrecht am Gigabit-Netz erhält und die Vergütung für seine Tätigkeit in erster Linie durch die Entgelte der Endkunden erhält, während der Konzessionsgeber lediglich einen Zuschuss zur Deckung der gegebenenfalls ausgewiesenen Wirtschaftlichkeitslücke leistet, welcher nach § 105 Abs. 1 Nr. 2 GWB einer Dienstleistungskonzession nicht entge- gensteht. Der Schwerpunkt der Tätigkeit des Konzessionsnehmers liegt auf der Dienstleistung des Betreibens des Breitbandnetzes über den Zeitraum von mindestens sieben Jahren. Der Konzessionsgeber ordnet weiter das zu planende, zu bauende und zu betreibende Gigabit-Netz auch als ein "öffentliches Kommunikationsnetz" i.S.d. Bereichsausnahme gemäß § 149 Nr. 8 GWB ein, so dass der 4. Teil des GWB nicht zur Anwendung kommt. Soweit in den Unterlagen des Auswahlverfahrens auf Normen des 4. Teils des GWB verwiesen wird, begründet dies keinen Anspruch auf deren Anwendbarkeit.
