In the light of Article 65 (1) (c) of the Kbt. 65 (1) and Article 26 (1) (b) of the Korm Regulation, the following information is provided: S.1. The tenderer is deemed technically and professionally unsuitable if: M/1. they do not have a reference for the provision of mobile voice and data transmission services performed continuously for a period of at least 9 months, which included at least 1,300 subscriptions providing mobile voice and data transmission services (i.e. the above suitability requirement must be fulfilled within a single reference). [PPA Section 65(1)(b), Government Decree 321/2015 (X. 30.) (Gov. Dec.) Section 21(3)(a)]. In connection with suitability requirement M1), the Contracting Authority states that the presented reference may be considered as performed within three years (36 months) prior to the date of dispatch of the contract notice if the date of performance (completion of performance) falls within this period, taking into account the provisions of Section 21(3a)(a) of the Gov. Dec. In accordance with the above, the Contracting Authority will take into account performances commenced within at most six years (72 months) and completed within three years (36 months) counted back from the date of dispatch of the contract notice. References must be verified by a certificate issued or signed by the other contracting party, or – if the other contracting party is not an organization under Section 5(1)(a)-(c) and (e)-(f) of the PPA, or in the case of non-Hungarian organizations, not a CA under Directive 2014/24/EU – by a declaration of the tenderer / other organization participating in the verification of suitability, or by a certificate issued by the other contracting party with the content described above. Section 22(1)-(2)] Joint tenderers may jointly satisfy the M/1) suitability requirement indicated above, or the tenderer may satisfy the suitability requirement by relying on the capacity of any other organization or person, regardless of the legal nature of the relationship between them, provided that for requirements which by their nature can only apply individually to economic operators, under the possibility of joint compliance, it is sufficient if one of them complies. In this case, the organization providing the capacity must be designated in the tender along with the indication of the relevant point of the contract notice and the suitability requirement(s) for the verification of which the tenderer relies or also relies on the resources of this organization, and a document containing a commitment – undertaken in a contract, preliminary agreement, or other form – by the organization placing its capacities at disposal must be attached to the tender, demonstrating that the resources necessary for the performance of the contract will be available during the period of performance of the contract. [PPA Section 65(6)-(7), (9)] M/1 Pursuant to Section 1(1) and Section 5(1) of Government Decree 321/2015 (X. 30.), the Tenderer must attach the European Single Procurement Document, for which it is sufficient to complete Section "α" of Part IV – pursuant to Section 2(5) of the Gov. Dec., the CA also accepts the simple declaration of the economic operator concerned for the preliminary verification of the technical and professional suitability requirements under M/1. Attention is drawn to Section 62(1)(i) and Section 73(1)(c) of the PPA. Pursuant to Section 1(2) of the Gov.
