What the buyer wants

The subject matter of the lot is the operation of the passive fibre optic network (FTTB) to be built in the Bärenthal market area under the gap closure programme under No 9.1 of the Gigabit Directive 2.0 (operating model under No 3.2), including subsequent network extensions (e.g. post-densification in the locations or development of construction areas) within the market area. The transfer of first operationally ready sub-grids to the network operator is planned for mid-2027, the transfer of the last sub-grid for 2028. By way of a service concession, the system operator shall ensure the operation of the network, including the deployment and operation of active technology, and shall provide Internet and telecommunication services, including bundled services, to private and commercial final customers. The network operator is also responsible for granting open access with active and passive wholesale products; the wholesale prices bindingly fixed by the Confederation with the participation of the Federal Network Agency are considered as an upper limit. In addition, maintenance, maintenance, repair, suppression, documentation and services as well as associated services. Gegenstand dieser Ausschreibung ist die Verpachtung der im Rahmen des Lückenschluss-Programms nach Nr. 9.1 der Gigabit-Richtlinie 2.0 (Betreibermodell nach Nr. 3.2) in den Gemarkungsgebieten Bärenthal und Neuhausen ob Eck (Landkreis Tuttlingen) zu errichtenden passiven Glasfasernetze (FTTB) an einen Netzbetreiber, der im Wege einer Dienstleistungskonzession den Netzbetrieb sicherstellt sowie Internet- und Telekommunikationsdienste gegenüber Endkunden erbringt. Dem Netzbetreiber obliegt zudem die Gewährung eines offenen Netzzugangs (Open Access) mit aktiven und passiven Vorleistungsprodukten; die vom Bund unter Beteiligung der BNetzA verbindlich festgelegten Vorleistungspreise gelten als Obergrenze. Hinzu kommen Wartung, Instandhaltung, Instandsetzung, Entstörung, Dokumentation und Serviceleistungen sowie zugehörige Leistungen. Umfasst sind auch spätere Netzerweiterungen. Die Überlassung der passiven Infrastruktur erfolgt auf Grundlage eines Netzbetriebs- und Pachtvertrages.

  2. Lot 2Los 2 - Neuhausen ob Eck Lückenschluss (LSP)

    Gegenstand des Loses ist der Betrieb des im Rahmen des Lückenschluss-Programms nach Nr. 9.1 der Gigabit-Richtlinie 2.0 (Betreibermodell nach Nr. 3.2) im Gemarkungsgebiet Neuhausen ob Eck zu errichtenden passiven Glasfasernetzes (FTTB) einschließlich späterer Netzerweiterungen (z. B. Nachverdichtungen in den Ortslagen oder Erschließung von Baugebieten) innerhalb des Gemarkungsgebiets. Die Übergabe erster betriebsfertiger Teilnetze an den Netzbetreiber ist für Mitte 2027, die Übergabe des letzten Teilnetzes für 2028 vorgesehen. Der Netzbetreiber stellt im Wege einer Dienstleistungskonzession den Netzbetrieb einschließlich Aufbau und Betrieb der aktiven Technik sicher und erbringt Internet- und Telekommunikationsdienste, auch als Bündelangebot, gegenüber privaten und gewerblichen Endkunden. Dem Netzbetreiber obliegt zudem die Gewährung eines offenen Netzzugangs (Open Access) mit aktiven und passiven Vorleistungsprodukten; die vom Bund unter Beteiligung der Bundesnetzagentur verbindlich festgelegten Vorleistungspreise gelten als Obergrenze. Hinzu kommen Wartung, Instandhaltung, Instandsetzung, Entstörung, Dokumentation und Serviceleistungen sowie zugehörige Leistungen. Die Überlassung der passiven Infrastruktur erfolgt im Wege der Pacht auf Grundlage des Netzbetriebs- und Pachtvertrags. Rahmenvereinbarung – Gebäudeanschlusspunkte (GAP): Mindestmenge 36 GAP (verbindlich), Höchstmenge 181 GAP (Planungs- bzw. Prognosewert) (Anlage Kundenpotenzial; Höchstmenge = GAP gesamt, Mindestmenge = 20 % der GAP gesamt). The applicant or the applicant community must maintain a company liability insurance with a minimum cover amount of EUR 10,000,000 per claim for personal injury and EUR 5,000,000 for material damage per claim with an insurance company licensed in a member state of the EU or a contracting state of the Agreement on the European Economic Area or, in the case of award of a contract. In the case of a consortium of applicants, it is sufficient that one of the members of the consortium has an appropriate level of insurance or provides it in the event of the award of the contract.

The minimum annual turnover net of the applicant or the applicant community according to § 45 Abs. 1 No. 1 and para 4 No. 4 VgV (corresponding) must have reached, with regard to the area of the services to be awarded and other services comparable to the service to be awarded, including the share of services performed together with other companies in the last 3 financial years per financial year, at least the amount stated below for the respective lot (minimum requirement in the competition for participation): Lot 1 Bärenthal (LSP): 101,000.00 Euro net Lot 2 Neuhausen ob Eck (LSP): 246.000.00 Euro net The minimum annual turnover is valid for each lot. In the case of an application for both lots, it shall be reached separately for each lot advertised; the minimum annual turnover is not added. In the case of subcontractors, an addition of the turnover shall be made only in the case of economic suitability lending after submission of corresponding commitments by subcontractors in accordance with the Commitment Subcontract Form.

The applicant or the candidate community must have provided at least three references of services comparable to the services to be awarded in the last five years; The relevant period shall be the period of five years before the expiry of the time limit for participation. Similar in this sense are projects relating to services related to the development of active technology and the active operation of a telecommunications network with connected final customers and the provision of retail services (Internet, telephone, television) to final customers. The services must have already been provided in substantial parts during the aforementioned period. This is the case if more than 30 % of the telecommunications network of the respective reference has been equipped with active technology
