INFORMATION ON CONDITIONS OF PARTICIPATION IN THE PROCEDURE Pursuant to Article 57(2) of the Public Procurement Act (PPL), Contractors who meet the conditions of participation in the procedure specified by the Contracting Authority may apply for the award of the contract. Pursuant to Article 112 of the PPL, the Contracting Authority specifies the following conditions of participation in the procedure regarding technical or professional capacity: In this scope, for Lot I of the contract, the Contracting Authority requires that the Contractor assign to the performance of the contract at least one person possessing valid professional surveying qualifications within the scope specified in Article 43(1) of the Act of 17 May 1989 – Geodetic and Cartographic Law (consolidated text: Journal of Laws of 2024, item 1151, as amended), who has managed the execution of a service consisting in the creation, conversion, or update of the GESUT database and/or the BDOT500 database. This person will direct the works during the performance of the contract. A. With respect to the condition concerning education, professional qualifications, or experience, contractors jointly applying for the contract award may rely on the capacities of those contractors who will perform the services for the realization of which these capacities are required. In such a case, contractors jointly applying for the contract award shall attach to the bid a statement indicating which services each contractor will perform. B. In order to confirm compliance with the conditions of participation in the procedure, in appropriate situations and with regard to a specific contract or a part thereof, the Contractor may rely on the technical or professional capacity or financial or economic situation of entities providing resources, regardless of the legal nature of the legal relations between them. With respect to the conditions relating to education, professional qualifications, or experience, contractors may rely on the capacities of entities providing resources if those entities perform the services for the realization of which those capacities are required. SUBJECTIVE MEANS OF EVIDENCE: In the case of joint application for the contract by Contractors, the required subjective means of evidence confirming the absence of grounds for exclusion shall be submitted by each Contractor. Subjective means of evidence confirming compliance with the conditions of participation in the procedure shall be submitted by contractors who possess the technical or professional capacity, i.e., education, professional qualifications, and experience necessary to perform the contract. The Contracting Authority will request a Contractor who relies on the technical or professional capacity of entities providing resources under the terms specified in Article 118 of the PPL to submit appropriate subjective means of evidence indicated in the Regulation of the Minister of Development, Labour and Technology of 23 December 2020 on subjective means of evidence and other documents or statements that may be requested by the contracting authority from the contractor (Journal of Laws of 2020, item 2415, as amended), also referred to below, regarding those entities, confirming that no grounds for exclusion from the procedure apply to them and that they meet the conditions of participation in the procedure to the extent that the Contractor relies on their resources. THE CONTRACTING AUTHORITY WILL APPLY THE SO-CALLED REVERSED PROCEDURE IN THE PROCEEDINGS (...) Pursuant to Article 124 of the PPL, in the procurement procedure, the Contracting Authority may request subjective means of evidence confirming compliance with the conditions of participation in the procedure. INFORMATION ON CONDITIONS FOR PARTICIPATION IN THE PROCEDURE Pursuant to Art. 57 item 2 of the Public Procurement Law (PPL), economic operators who meet the conditions for participation in the procedure specified by the Contracting Authority may apply for the award of the contract. Based on Art. 112 of the PPL Act, the Contracting Authority specifies the following conditions for participation in the procedure regarding technical or professional capacity: In this scope, for Lot I of the contract, the Contracting Authority requires the Economic Operator to have performed, within the last 5 years prior to the deadline for submission of tenders (and if the period of business activity is shorter – within this period), at least one service or several services consisting of the creation, conversion, or updating of a GESUT database and/or a BDOT500 database with a total value of not less than PLN 50,000 gross. A. With regard to the condition concerning education, professional qualifications, or experience, economic operators jointly applying for the contract award may rely on the capacities of those operators who will perform the services for the execution of which these capacities are required. In such a case, the economic operators jointly applying for the award of the contract shall attach to the tender a statement indicating which services each of the operators will perform. B. In order to confirm compliance with the conditions for participation in the procedure, an economic operator may, in appropriate situations and with regard to a specific contract or part thereof, rely on the technical or professional capacity or financial or economic standing of entities providing resources, regardless of the legal nature of the legal relationships between them. With regard to conditions concerning education, professional qualifications, or experience, economic operators may rely on the capacities of entities providing resources if those entities perform the services for the execution of which these capacities are required. SUBJECTIVE MEANS OF EVIDENCE: In the case of economic operators applying jointly for the contract, the required subjective means of evidence confirming the absence of grounds for exclusion shall be submitted by each of the Economic Operators. INFORMATION ON THE CONDITIONS FOR PARTICIPATION IN THE PROCEDURE Pursuant to Article 57(2) of the Public Procurement Law (Pzp), Economic Operators who meet the conditions for participation in the procedure specified by the Contracting Authority may apply for the award of the contract. Pursuant to Article 112 of the Public Procurement Law, the Contracting Authority specifies the following conditions for participation in the procedure regarding technical or professional ability: In this regard, the Contracting Authority requires for Part VI of the contract that the Economic Operator assign to the contract performance at least one person holding valid professional geodetic qualifications in the scope specified in Article 43(1) of the Act of 17 May 1989 – Geodetic and Cartographic Law /consolidated text Journal of Laws of 2024, item 1151, as amended/, who managed the provision of a service consisting of the creation, conversion, or updating of the GESUT database and/or the BDOT500 database. This person will manage the works during the execution of the contract. A. With respect to the condition concerning education, professional qualifications, or experience, economic operators jointly applying for the contract award may rely on the abilities of those economic operators who will perform the services for the execution of which these abilities are required. In such a case, economic operators jointly applying for the contract award shall attach to the tender a statement indicating which services each of the economic operators will perform. B. In order to confirm compliance with the conditions for participation in the procedure, an Economic Operator may, in appropriate situations and with respect to a specific contract or a part thereof, rely on the technical or professional abilities or the financial or economic standing of entities providing resources, regardless of the legal nature of the legal relationships connecting it with them. With respect to the conditions concerning education, professional qualifications, or experience, economic operators may rely on the abilities of the entities providing resources if these entities will perform the services for the execution of which these abilities are required. SUBJECTIVE MEANS OF EVIDENCE: In the case of economic operators jointly applying for the contract, the required subjective means of evidence confirming the absence of grounds for exclusion shall be submitted by each of the Economic Operators. Subjective means of evidence confirming compliance with the conditions for participation in the procedure are submitted by economic operators that have the technical or professional ability, i.e., the education, professional qualifications, and experience necessary to perform the contract.
