Infringements of procurement rules which can be identified on the basis of the contract notice or in the procurement documents shall be brought before the contracting authority/entity at the latest by the expiry of the deadline for the submission of applications or tenders. In addition, violations of procurement rules must be reported to the customer within a period of 10 calendar days to the knowledge. A review request must be submitted to the competent awarding chamber within 15 calendar days of receipt of the notification of the client that he does not wish to remedy a complaint (§ 160 of the German Competition Restrictions Act (GWB)). The aforementioned deadlines do not apply if the client has awarded the contract in accordance with § 135 (1) no. 2 GWB without prior publication of a notice in the Official Journal of the European Union, without this being permitted by law. If a contracting entity disregards the ineffectiveness of a concluded contract in which it has disregarded the obligation to provide information and wait (§ 134 GWB) or has awarded without prior publication of a notice in the Official Journal of the European Union, without this being permitted by law, the ineffectiveness can only be established if it has been asserted in the review procedure within 30 calendar days after the contracting authority has informed the tenderers and candidates concerned about the conclusion of the contract, but not later than 6 months after the conclusion of the contract. If the contracting entity has published the contract in the Official Journal of the European Union, the period ends 30 calendar days after publication of the contract notice in the Official Journal of the European Union (§ 135 GWB).
