The tenderer shall demonstrate that for the last 3 years by the closing date for the submission of tenders, it has supplied products similar to those which are purchased for each lot. In order to be considered qualified, the tenderer must provide proof that over the last 3 years it has supplied similar products whose value without cumulative VAT, at the minimum one contract - maximum three contracts, relative to each lot, was at least: Lot 1 - 560,000 lei Lot 2 - 60,000 lei Lot 3 - 30,000 lei Lot 4 - 190,000 lei Lot 5 - 53,000 lei To prove similar experience The offeror will prove that over the last 3 years he has supplied similar products to those subject to purchase for each lot for which he submits his offer. For foreign legal persons, the previous requirement shall be deemed to be proven by supporting documents issued by the authorities of the country of residence. The number of years related to similar experience shall be calculated by reference to the closing date for submission of tenders set out in the contract notice. For equivalence, account shall be taken of the average annual rate of MDL / foreign currency communicated by the NBR for that year. The economic operator may invoke the support of a third party / third party for the requirement of similar experience, presenting a commitment to that effect by the third party / third party. With the support commitment, the tenderer / candidate is required to submit documents submitted to him by the supporting third party / third party / s, resulting in the effective way in which the supporting third party / third party / s will / will ensure the fulfilment of its own support commitment, which will be attached to that commitment. The undertaking shall ensure that the contracting authority fulfils the obligations assumed by it, where the contractor has difficulties during the performance of the contract. The tenderer is required to submit documents (supply contracts, acceptance minutes, recommendations from the beneficiaries on the fulfilment of contractual obligations, compliance with delivery time limits, compliance with time limits for failure during the warranty period, etc.) stating that, in the last three years, it has provided or participated in the supply of products similar to those under purchase. The method of fulfilment shall be completed by the DUAE in the specific section in accordance with Article 12 of Instruction 2 / 2017 ANAP where it is specified how the DUAE will be completed in relation to similar experience, namely: "the number and date of the contract invoked as similar experience, its beneficiary and its contact details, the date and number of the receipt document, and the weight and / or activities for which it was responsible, together with their value, without VAT." Only the highest bidder in the intermediate ranking will submit supporting documents (contracts accompanied by reception minutes or recommendations from beneficiaries or other evidence confirming the actual supply of the products, their completion and supporting those presented in the DUAE).

The operator / economic operators shall declare the part / parts of the contract that they may intend to subcontract and the identification data of the proposed subcontractors. A list will be drawn up to specify the part (s) of the contract that is intended to be subcontracted (mention of the activities to be subcontracted and their percentage or value). The subcontracting agreement shall also be submitted upon submission of the DUAE. When signing the contract, the successful tenderer shall submit the contract / contracts with the subcontractor / subcontractors nominated in the tender in copy. During the performance of the contract, the tenderer shall not be entitled to replace the subcontractors nominated in the tender without the consent of the contracting authority and any replacement of the subcontractors shall not result in the modification of the technical or financial proposal. The procedure will be completed - DUAE in the specific section and will be submitted if applicable Form 2 - Information regarding the part of the contract that the economic operator / operators possibly intends to subcontract and the identification data of the proposed subcontractor. To this end, a list will be drawn up specifying the part of the contract that is intended to be subcontracted (mention of activities to be subcontracted and their percentage or value). Subcontracting agreement will be submitted. Where the tenderer uses the capacities of the subcontractor / subcontractors to meet the qualification criteria, a separate DUAE form shall be submitted for each of those subcontractors, duly completed and signed by each of them.
