Procurement, renewal and upgrade of software licenses

Economic operators established in a Member State of the European Union are required to be registered in one of the professional or commercial registers kept in their State of establishment or to satisfy any other requirement set out in Annex XI to Appendix I to Law 4412/2016.

In the case of economic operators established in a Member State of the European Economic Area (EEA) or in third countries joining the GPA, or in third countries not falling under the previous indent and having concluded bilateral or multilateral agreements with the Union on procurement procedures, they are required to be registered in corresponding professional or commercial registers. Economic operators established in Greece are required to be registered in the Chamber of Commerce.

In the case of an association of economic operators, the suitability for professional activity should be covered by all members of the association.

Economic operators are required to have a general annual turnover for each of the last three (3) management uses (2023, 2024, 2025) greater than the budget of the project to be awarded, not including VAT and option. Where the candidate Contractor is active for a period of less than three (3) management uses, then the minimum general annual turnover for the management uses concerned should be greater than the budget of the project to be awarded, excluding VAT and option. The relevant EEW paragraph shall be completed. In the case of an association of economic operators, the above minimum requirements are cumulatively covered by the members of the association.

Economic operators are required to designate Project Manager with the following minimum qualifications: (i) a basic diploma of the National Higher Educational Institute in the field of positive sciences or a recognised equivalent qualification of foreign schools; In the case of an association of economic operators, the above minimum requirements are cumulatively covered by the members of the association.

Economic operators for this procurement procedure must comply with the following standards:

• ISO 9001:2015 Quality Management System with scope of supply, installation and support of information systems The contracting authority shall recognise equivalent certificates issued by bodies accredited by equivalent accreditation bodies, established in other Member States, in accordance with Regulation 765/2008.It shall also, upon examination, accept other evidence of equivalent quality assurance measures, provided that the economic operator concerned has not been able to obtain those certificates within the relevant time limits for reasons for which he is not responsible, provided that the economic operator demonstrates that the proposed quality assurance measures meet the required quality assurance standards. In the case of an association, these requirements must be covered by each member of the association.

Economic operators are required to have the right to resell software licenses of their software manufacturer through the Enterprise Agreement.
