What the buyer wants

1. The subject matter of the contract is services: "Provision of telecommunications services in the scope of wireless two-way 24/7 data transmission and activation of APNs". 2. The purpose of the contract implementation is to ensure connectivity with devices recording road traffic offenses and to ensure mobile connectivity of inspectors with the GITD (General Inspectorate of Road Transport) ICT network. 3. A detailed Description of the Subject Matter of the contract is specified in SWZ Part III Description of the Subject Matter of the Contract and in Part IV of the SWZ (Draft Contractual Provisions - PPU). 4. The Contractor is not required to provide a bid security (wadium). 5. The Contractor is required to provide a performance security for an amount equal to: 5% of the total price specified in the tender in accordance with Article 452(2) of the Public Procurement Law (PPL). 6. The Contracting Authority, in accordance with the provisions of Article 441 of the PPL, provides for the possibility of using the right of option. 7. The Contracting Authority does not allow the submission of partial tenders. 8. The Contracting Authority does not allow the submission of variant tenders. 9. The Contracting Authority does not require the submission of subject-matter evidence with the tender. 10. The Contracting Authority does not provide for the possibility of supplementing subject-matter evidence pursuant to Article 107(2) of the PPL. 11. The Contracting Authority does not provide for a pre-tender meeting with Contractors. 12. The Contracting Authority does not provide for an electronic auction referred to in Articles 227–238 of the PPL. 13. The Contracting Authority does not provide for the possibility of awarding contracts referred to in Article 214(1)(7) of the PPL. 14. The Contracting Authority does not provide for reimbursement of participation costs in the procedure, except in the situation referred to in Article 261 of the PPL. 15. The Contracting Authority allows the participation of subcontractors in the performance of the contract. 15.1. In the case of subcontractor participation in the performance of the contract, the Contracting Authority, pursuant to Article 462(2) of the PPL, requires the Contractor to indicate the parts of the contract the performance of which it intends to entrust to subcontractors, and to provide the names of the subcontractors' companies (if known). 15.2. Entrusting the performance of part of the contract to subcontractors does not release the Contractor from liability for the proper performance of the contract. 16. The Contracting Authority does not reserve the obligation of personal performance by the Contractor of key tasks related to the execution of the subject matter of the contract. 17. The Contracting Authority does not reserve the obligation of personal performance by individual Contractors jointly applying for the award of the contract of key tasks related to the execution of the subject matter of the contract. 18. The Contracting Authority does not set a requirement regarding the employment by the Contractor of the persons referred to in Article 96(2)(2) of the PPL. 19. Due to the fact that the activities performed by persons designated to execute the public contract do not consist in the performance of work within the meaning of Article 22 § 1 of the Labour Code, the Contracting Authority does not specify the requirement of employment by the contractor or subcontractor of persons under an employment contract. 20. The Contracting Authority does not reserve requirements related to the contract execution referred to in Article 96(1) of the PPL. 21. The Contracting Authority does not reserve requirements related to the contract execution referred to in Article 101(1) of the PPL. 22. GDPR - Information Clause included in the SWZ. 23. 1. Przedmiot zamówienia są usługi: „Świadczenie usług telekomunikacyjnych w zakresie bezprzewodowej dwukierunkowej transmisji danych przez całą dobę oraz uruchomienie APNów”. 2. Celem realizacji zamówienia jest zapewnienie łączności z urządzeniami rejestrującymi wykroczenia drogowe oraz dla zapewnienia łączności mobilnej inspektorów z siecią teleinformatyczną GITD. 3. Szczegółowy Opis Przedmiotu zamówienia został określony w SWZ Cz. III Opis przedmiotu zamówienia oraz w IV Cz. SWZ (PPU). 4. Wykonawca nie jest zobowiązany do wniesienia wadium. 5. Wykonawca jest zobowiązany do wniesienia zabezpieczenia należytego wykonania umowy na kwotę stanowiącą: 5 % ceny całkowitej podanej w ofercie zgodnie z art. 452 ust. 2 ustawy Pzp. 6. Zamawiający zgodnie z zapisem art. 441 ustawy Pzp przewiduje możliwość zastosowania prawa opcji. 7. Zamawiający nie dopuszcza możliwości składania ofert częściowych. 8. Zamawiający nie dopuszcza możliwości składania ofert wariantowych. 9. Zamawiający nie żąda złożenia wraz z ofertą przedmiotowych środków dowodowych. 10. Zamawiający nie przewiduje możliwości uzupełnienia przedmiotowych środków dowodowych na podstawie art. 107 ust. 2 ustawy Pzp. 11. Zamawiający nie przewiduje przeprowadzenia zebrania przedofertowego z Wykonawcami. 12. Zamawiający nie przewiduje przeprowadzenia aukcji elektronicznej, o której mowa w art. 227–238 ustawy Pzp. 13.Zamawiający nie przewiduje możliwości udzielania zamówień, o których mowa w art. 214 ust. 1 pkt 7) ustawy Pzp. 14.Zamawiający nie przewiduje zwrotu kosztów udziału w postępowaniu, za wyjątkiem zaistnienia sytuacji, o której mowa w art. 261 ustawy Pzp. 15.Zamawiający dopuszcza udział podwykonawców przy realizacji zamówienia. 15.1. W przypadku udziału podwykonawców przy realizacji zamówienia Zamawiający, zgodnie z art. 462 ust. 2 ustawy Pzp, żąda wskazania przez Wykonawcę części zamówienia, których wykonanie zamierza powierzyć podwykonawcom, i podania przez Wykonawcę nazw firm podwykonawców (o ile są znane). 15.2. Powierzenie wykonania części zamówienia podwykonawcom nie zwalnia Wykonawcy z odpowiedzialności za należyte wykonanie zamówienia. 16.Zamawiający nie zastrzega obowiązku osobistego wykonania przez Wykonawcę kluczowych zadań dotyczących realizacji przedmiotu zamówienia. 17.Zamawiający nie zastrzega obowiązku osobistego wykonania przez poszczególnych Wykonawców wspólnie ubiegających się o udzielenie zamówienia kluczowych zadań dotyczących realizacji przedmiotu zamówienia. 18.Zamawiający nie stawia wymogu w zakresie zatrudnienia przez Wykonawcę osób, o których mowa w art. 96 ust. 2 pkt 2) ustawy Pzp. 19.Z uwagi, iż czynności wykonywane przez osoby wskazane do realizacji zamówienia publicznego nie polegają na świadczeniu pracy w rozumieniu art. 22 § 1 Kodeksu pracy, Zamawiający nie określa wymogu zatrudniania przez wykonawcę lub podwykonawcę osób na podstawie umowy. 20.Zamawiający nie zastrzega wymagań związanych z realizacją zamówienia, o których mowa w przepisie 96 ust. 1 ustawy Pzp. 21. Zamawiający nie zastrzega wymogów i wymagań związanych z realizacją zamówienia, o których mowa w przepisie 101 ust. 1 ustawy Pzp. 22.RODO - Klauzula Informacyjna zawarta w SWZ. 23.Zamawiający nie przewiduje, że w przedmiotowym postępowaniu udzieli zaliczek na poczet wykonania zamówienia. 24.Terminy realizacji poszczególnych obowiązków Wykonawcy, składających się na przedmiot zamówienia, zostały określone w Projektowanych Postanowieniach Umowy stanowiących Część IV SWZ oraz w opisie przedmiotu zamówienia wskazanym w Części III SWZ. 25. Wizja lokalna: 25.1. Zamawiający przewiduje możliwość uczestnictwa Wykonawcy ubiegającego się o udzielenie zamówienia w wizji lokalnej w celu sprawdzenia warunków związanych z wykonaniem przedmiotu zamówienia. 25.2. Brak uczestnictwa w wizji lokalnej nie stanowi podstawy do odrzucenia oferty Wykonawcy, o której mowa w art. 226 ust. 1 pkt 18 ustawy Pzp, ze względu na fakt, iż udział w niej jest fakultatywny. The Contracting Authority shall consider the condition to be satisfied if the Contractor demonstrates that he has the power to conduct telecommunications activities in accordance with Article 5 of the Act of 12 July 2024. – Law of electronic communication (Journal of Laws of 2024 item 1221) and is an entity entered in the register of telecommunications entrepreneurs, conducted by the President of the Office of Electronic Communications. -------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------- The Contracting Authority shall, pursuant to Article 126(1) of the PZp Act, invite the Contractor whose offer has been assessed at the most, to submit, within a specified period of time, no less than 10 days, up to the date of the submission of the following body of evidence: - as regards the condition for the right to conduct a particular economic or professional activity: the applicable certificate of entry in the telecommunications business register confirming the right to conduct a business activity in the field of telecommunications in accordance with Article 5 of the Act of 12 July 2024. – Law of electronic communication (Journal of Laws of 2024 item 1221).

The Contracting Authority does not impose requirements on Contractors in the scope of this procedure.
