Purchase of migration of the Department Economics Assistance System (SWEZ) to the new version and support and consultation services for the migration process

The economic operator will comply with the condition if it demonstrates that during the last 3 (three) financial years before the deadline for the submission of tenders, and if the period of business is shorter, during that period, it has achieved an average annual net revenue from the sale of products, goods, services and materials from its business of not less than PLN 25 000 000,00 (in words: PLN twenty-five million). The Contracting Authority explains that the average net revenue is related to revenue over a period of 12 months, so that when the Contractor submits a report or part of it for a financial period other than 12 months, as referred to above, before calculating the average, the Contracting Authority will be converted proportionately for the 12-month period. Note: In the case of Contractors jointly applying for a contract, the above condition shall be deemed to be fulfilled if at least one Contractor confirms in full that the condition of participation is met. Where the Contractor relies on the economic situation of the entities making the resources available, the above condition must be fulfilled in full by at least one of those entities. To confirm the fulfilment of the condition of participation in the proceedings referred to above, the Contractor shall submit a financial report or a part thereof where the report is required by the provisions of the country in which the Contractor is established and if it is audited by the audit firm in accordance with the accounting rules, also with the audit report, respectively, and in the case of Contractors not obliged to draw up the financial statements, other documents, specifying, in particular, revenue and assets and liabilities, for a period not exceeding the last 3 trading years and if the period of business is shorter for that period.

The Contractor will satisfy the condition if it demonstrates that within the last 5 years prior to the deadline for submission of tenders, and if the period of business activity is shorter – within this period, it properly performed at least two contracts involving the provision of the service of: migration or development or extension involving the implementation of an integrated SAP S/4HANA ERP class IT system using cloud technology. Each of the aforementioned contracts should include at least the following elements: conducting analyses of processes executed in the system in terms of their implementation, preparation of: implementation documentation describing the manner of production go-live of the system, user documentation, software development, software testing, software acceptance, user training, for at least the following functional areas of the system: a) Accounting and Finance, b) Strategic Management of the Organization in the Area of Finance, c) Human Resources Management, d) Materials Management, e) Fixed Asset Management, f) Controlling, g) Purchasing Management, h) Contract Management, i) Reporting (data warehouse); provided that: 1. the value of each of these contracts was at least PLN 5,000,000.00 net (excluding VAT) (in words: five million Polish zlotys 00/100); 2. each of the above contracts related to a system used by a minimum of 3,000 users, i.e. active named accounts; 3. it is permissible to replace each of the two contracts referred to above with two smaller contracts, provided that: 1) the total value of the combined smaller contracts is at least PLN 5,000,000.00 net (excluding VAT) (in words: five million Polish zlotys 00/100), whereby the Contracting Authority does not permit combining more than two smaller contracts, 2) each of the combined smaller contracts included migration or development or extension services involving the implementation of an integrated SAP S/4HANA ERP class IT system using cloud technology; 3) the combined smaller contracts jointly cover all functional areas specified above in items a) - i); 4) each of the combined smaller contracts satisfies the requirements of point 2 regarding 3,000 users. 4. in the case of contracts/agreements that also included the provision of other services or deliveries, the Contracting Authority requires the Contractor to demonstrate that the value of the contract scope required in the above condition and actually completed corresponded to the amount specified in the description of the condition (the value of services or deliveries going beyond the description of the condition cannot be taken into account in the value required to meet the condition). Note No. 1: In the case of Contractors jointly applying for the award of the contract, the above condition will be deemed satisfied if at least one of the Contractors confirms in full the fulfillment of the subject condition for participation. Where the Contractor relies on the technical or professional capacity of entities making resources available, the above condition must be satisfied in full by at least one of these entities. Note No. 2: Where the Contractor uses experience gained under services provided as part of a consortium, the Contractor may invoke the performance of such a service only if it actually and specifically participated in its performance, i.e. performed the services described in the condition. An identical requirement applies to experience lent by a third party. Note No. 4: Contractors jointly applying for the award of the contract shall attach to the tender a statement indicating which elements of the contract will be performed by the individual Contractors (in accordance with Annex No. 8 to the SWZ). The Contractor will meet the condition if it demonstrates that it has at its disposal or will have at its disposal a dedicated team (i.e. intended for the performance of the contract), consisting of at least 31 (thirty-one) persons with appropriate qualifications and experience specified in the points below. These persons should possess experience and qualifications appropriate to the functions to be entrusted to them, i.e.: 1. at least 1 (one) person dedicated to perform the function of Contract/Project Manager, who: a) has a minimum of 5 years of professional experience understood as participation in the implementation of IT projects, b) has at least 3 years of professional experience in performing the function of Contract/Project Manager or Deputy Contract/Project Manager, within the last 5 (five) years prior to the deadline for submitting tenders, in an IT project/projects involving the provision of migration services or the construction or expansion including the implementation of substantive areas of the SAP S/4HANA environment (a single project is understood as a single contract), c) participated as Contract/Project Manager (within the last 5 (five) years prior to the deadline for submitting tenders) in 2 (two) completed projects of implementation or migration to the SAP S/4 HANA system (a single project is understood as a single contract) for a minimum of 5 (five) substantive areas specified in point 4.1.1.4.1.1. letters a) - i) of the SWZ (Tender Specifications), implemented or migrated under 1 (one) project, d) possesses the skills necessary to obtain a PRINCE2™ Practitioner or PMI or IPMA Level C certificate, confirmed by such document or another equivalent document confirming at least such skills as the aforementioned document, issued by an entity independent of the Contractor (a self-declaration of the Contractor or an affiliated entity within the meaning of Article 108(1)(5) of the Public Procurement Law Act is not permitted as the other document referred to in the sentence above); 2. at least 1 (one) person dedicated to perform the function of SWEZ3 Architect in the scope of developing the architecture for the entire SWEZ3 solution, who possesses: a) a minimum of 5 years of professional experience understood as participation in the implementation of IT projects related to implementation or migration to SAP S/4HANA solutions carried out using cloud technology, b) experience in the role of Architect, confirmed by participation (within the last 5 (five) years prior to the deadline for submitting tenders) in at least 3 (three) different implementation or migration projects to the SAP S/4HANA system (a single project is understood as a single contract), provided that: at least two of the three projects described above (in this sub-item) concerned the implementation or migration of all substantive areas combined from among those listed in point 4.1.1.4.1.1. letters a) - i) of the SWZ, c) experience in using Enterprise Architect and UML notation and at least 1 (one) tool supporting transformation to the SAP S/4HANA system version, including: • business process analysis, • business process mapping in SAP S/4HANA, d) experience in the implementation of at least 2 (two) projects, within the last 5 (five) years prior to the deadline for submitting tenders, which included the integration of the SAP S/4HANA environment with other external systems and applications, including ensuring system performance and throughput in cloud architecture (a single project is understood as a single contract), e) skills necessary to obtain the certificate: • SAP Certified Professional - Solution Architect – SAP BTP or • SAP Certified Professional - SAP Enterprise Architect, confirmed by such document or another equivalent document confirming at least such skills as the above-mentioned SAP certificates for SAP S/4HANA solutions, issued by an entity independent of the Contractor (a self-declaration of the Contractor or an affiliated entity with…

3. a minimum of 1 (one) person to serve as a Data Architect who possesses: a) a minimum of 5 years of professional experience understood as participation in the execution of IT projects related to the implementation of or migration to SAP S/4HANA solutions implemented using cloud technology, b) experience in at least 3 (three) different projects concerning the implementation of or migration to the SAP S/4HANA system (one project is understood as one contract) within the last 5 (five) years prior to the tender submission date, with each of the above projects including: • designing relational structures for the entire ERP environment, SQL query optimization, dataset management in cloud ERP systems within the scope of system operation in at least the following areas: Accounting and Finance, Strategic Management of the Organization in the Area of Finance, Materials Management, Fixed Asset Management, and Reporting for the listed areas, • workflow construction, visualization, reporting, and data storage in SAP HANA databases, optimization for performance and compliance with contracting authority requirements, as well as data integration between the cloud ERP environment and other IT systems, • quality control of the implemented/migrated ERP environment, at least in the area of optimal data flow between system areas and, in the case of data migration, data correctness, • implementation of best practices recommended by the Software Manufacturer and tools for data migration to the SAP S/4HANA system implemented in cloud technology, c) skills necessary to obtain a certificate confirming knowledge and competence in the design of SAP HANA database structures, confirmed by an appropriate certificate issued by an entity independent of the Contractor or another equivalent document (an own statement of the Contractor or of an affiliated entity within the meaning of Article 108(1)(5) of the Public Procurement Law is not permitted as another document referred to in the preceding sentence); 4. a minimum of 3 (three) persons to serve as SWEZ3 Developers who possess: a) a minimum of 5 years of professional experience understood as participation in the execution of IT projects related to the implementation of or migration to SAP S/4HANA solutions, b) experience in the role of Developer confirmed by participation in at least 3 (three) implementation or migration projects for the SAP S/4HANA system (one project is understood as one contract), within the last 5 (five) years prior to the tender submission date, with each of the above projects including: • implementation of or migration to ERP class systems using cloud technology for all functional areas listed in point 4.1.1.4.1.1. items a) - i) of the SWZ; • development work, implementation of customer enhancements, and implementation of integrations with other IT systems, taking into account the optimal use of system subscriptions and applying best practices in this area, c) skills necessary to acquire knowledge and competence in programming in SAP S/4HANA solutions using cloud technology, confirmed by an appropriate certificate issued by an entity independent of the Contractor or another equivalent document (an own statement of the Contractor or of an affiliated entity within the meaning of Article 108(1)(5) of the Public Procurement Law is not permitted as another document referred to in the above sentence); 5. a minimum of 4 (four) persons to serve as Lead Expert/Consultant for a group of system migration areas, i.e. at least one person for each of the groups of migration areas to SWEZ3: • financial areas group, including: Strategic Management of the Organization in the Area of Institution's Finance, Investment Requests, Contract Management, Financial Accounting of the Institution, Financial Accounting of Funds, Cash Flow Management, Controlling; • HR areas group, including: Human Resources Management – Personnel Administration, including business travel; Human Resources Management – Payroll, in…

6. minimum 19 (nine) persons to perform the functions of the Expert/Consultant of the migration area of the system, i.e. at least 1 (one) person for each migration area to SWEZ3, i.e.: • Financial Accountancy of the Plant, • Financial Accountancy of the Funds, • Strategic management of the organisation in the area of Finance of the Plant, • Investment Applications, • Management of purchases, • Management of liquidity, • Material Management, • Refurbishment Economy, • Management of assets, • Sales - Instrumentation, • Management of real estate, • Management of contracts, • Fleet Management, • Management of human resources – staff, including business trips, • Management of human resources – wages, including Planning of Personal Costs and ZFŚS, • Controlling, • Integration, • Integration, • Administration of the system, which have: a) at least 5 years of professional experience as an Expert/Consultant on implementation or migration to SAP S/4HANA, confirmed in at least 3 (three) of the project submission of one (three) of which has been In the field of experts/consultants of human resources management areas, each of the above [at least 3 (three)] projects had to be implemented with a client employing more than 1000 employees. (one) person responsible for the implementation of the implementation of the project.

Each of these functions must be performed by another person. The specialists mentioned in points 1, 5 - 7 must speak Polish fluently in speech and writing. 4) where only information is provided on the year of commencement or completion of the project, The Contracting Authority will adopt on 31 December of the year in question (for the start of the project) and on 1 January of the year in question (for the completion of the project) - if it is the same year, the Contracting Authority will not recognise the experience for this IT project. Note: In the case of Contractors jointly applying for the award of the above condition, if the total number of members of the dedicated team with the qualifications and experience of the consortiums together confirms the requirements of the above condition. Where the Contractor relies on the technical or professional capacity of the entities making the resources available, the above condition shall be deemed to be fulfilled if the total number of members of the team dedicated to the SGM of the qualifications and experience available to the Contractor and the entities making the resources available confirms the requirements resulting from the above condition of participation. To confirm the fulfilment of the conditions for participation in the procedure referred to above, the Contractor shall submit: a list of persons addressed by the Contractor for the performance of the public contract in accordance with the scope set out in the model, which is Annex 11A to the SWZ, to confirm compliance with the condition in the scope of the Contract/Project Manager, Architect SWEZ3, Data Architect, Developers SWEZ3, Expert/Consultant leading the group of system migration areas (financial area group, HR area group, logistics area group, property management area group), Expert/Consultant of the system migration area (Financial Accountancy of the Plant, Financial Accounting of Funds, Strategic Management of the Organization in the area of Finance of the Plant, Investment Applications, Material Management, Management of permanent assets, Property management, Human resources management – staff, including missions, Human resources management – wages, including Cost Planning and ZFŚS, Controlling, Reporting, System Administration) and Annex 11B to the SWI – to confirm the condition of participation in the process in the area of migration (in the area of migration: Purchase management, Financial liquidity management, Repair management, Sales - Invoicing, Contract management, Fleet management, Integration), SWEZ3 Test Coordinator, Security Specialist.

The Contractor will satisfy the condition if it demonstrates that within the last 5 years prior to the deadline for submission of tenders, and if the period of business activity is shorter – within this period, it properly performed at least: 1. two contracts involving the provision of advisory services in the scope of: migration or development or extension involving the implementation of an integrated SAP S/4HANA ERP class IT system using cloud technology, each covering at least the following elements: needs analysis and/or supervision over the implementation project(s) including inspection, monitoring the correctness of work performance, consulting on the optimization of implementation solutions, and assessment of readiness for production go-live of the system for at least the following functional areas of the system: a) Accounting and Finance, b) Strategic Management of the Organization in the Area of Finance, c) Human Resources Management, d) Materials Management, e) Fixed Asset Management, f) Purchasing Management and Contract Management, g) Controlling, h) Reporting (data warehouse); provided that: 1) the value of each of these contracts in the scope of advisory services was at least PLN 2,000,000.00 net (excluding VAT) (in words: two million Polish zlotys 00/100); 2) each of the above contracts related to a system used by a minimum of 3,000 users, i.e. active named accounts; 3) it is permissible to replace each of the two contracts referred to above in point 1 with two smaller contracts, provided that: a) the total value of the combined smaller contracts is at least PLN 2,000,000.00 net (excluding VAT) (in words: two million Polish zlotys 00/100), whereby the Contracting Authority does not permit combining more than two smaller contracts, b) each of the combined smaller contracts included advisory services in the scope of: migration or development or extension involving the implementation of an integrated SAP S/4HA ERP class IT system using cloud technology, c) the combined smaller contracts jointly cover all functional areas specified in point 1 items a) - h), d) each of the combined contracts satisfies the requirements of point 2) regarding 3,000 users; 4) in the case of contracts/agreements that also included the provision of other services or deliveries, the Contracting Authority requires the Contractor to demonstrate that the value of the contract scope required in the above condition and actually completed corresponded to the amount specified in the description of the condition (the value of services or deliveries going beyond the description of the condition cannot be taken into account in the value required to meet the condition); or 2. two contracts involving the provision of the service of: migration or development or extension involving the implementation of an integrated SAP S/4HANA ERP class IT system using cloud technology, each covering at least the following elements: conducting functional requirements analysis, preparation of: analytical documentation describing the method of their implementation in the system, implementation documentation describing the method of implementing the change, user documentation, software development, software testing, software acceptance for at least the following functional areas of the system: a) Accounting and Finance, b) Strategic Management of the Organization in the Area of Finance, c) Human Resources Management, d) Materials Management, e) Fixed Asset Management, f) Purchasing Management and Contract Management, g) Controlling, h) Reporting (data warehouse); provided that: 1) the value of each of these contracts in the scope of migration or development or extension services was at least PLN 5,000,000.00 net (excluding VAT) (in words: five million Polish zlotys 00/100); 2) each of the above contracts related to a system used by a minimum of 3,000 users, i.e. active named accounts; 3) it is permissible to replace each of the two contracts referred to in point 2 with t…

Note 1: In the case of Contractors jointly applying for the above-mentioned award, the condition shall be deemed to be fulfilled if at least one Contractor confirms in full that the condition of participation in question is met. Where the Contractor relies on the technical or professional capacity of the entities making the resources available, the above condition must be fulfilled in full by at least one of those entities. Note 2: If the Contractor uses the experience acquired on the basis of the services provided in the consortium, then the Contractor may rely on the provision of such service if, in fact and specifically, he participated in its implementation, i.e. he has provided the services described in the condition. The same requirement applies to the experience of a third party. Note 3: Contractors jointly applying for a contract shall attach a declaration to the tender, indicating which elements of the contract will be performed by each Contractor (as set out in Annex 8 to the SWZ). To confirm compliance with the conditions for participation in the procedure referred to above, the Contractor shall submit: a list of services performed during the last 5 years before the deadline for the submission of tenders and, if the period of business is shorter, during that period, including the subject matter, the values, the dates of performance and the entities for which the services have been carried out, drawn up in accordance with the model set out in Annex 12 to the SWZ and the addition of evidence indicating whether those services have been duly completed. Proof that the services have been duly performed is, inter alia,: − references or other documents drawn up by the entity for which the services have been performed, − the Contractor's statement - if the Contractor is unable to obtain these documents for reasons beyond his control.

The contractor shall comply with the condition if it demonstrates that he has or will have a dedicated team (i.e. dedicated to the performance of the contract), consisting of at least 19 persons with the appropriate qualifications and experience indicated in the points below and for which there is no conflict of interest. 3. minimum 1 (one) person to perform the functions of Data Architect who has: (a) a minimum of 5 years of professional experience understood as participating in the implementation or migration of IT projects to SAP S/4 HANA or the implementation or migration services to SAP S/4 HANA (under the concept of one project we understand one contract) within the last 5 (five) years before the day of the submission of tenders, each of the above projects covering: • the design of relation structures for the entire ERP environment, the optimization of SQL queries, the management of data collections in cloud ERP systems for the operation of the system at least in the following areas: Accounting and Finance, Strategic Management Organisation in Finance, Material Economy, Management of durable assets and reporting for these areas, • the construction of flow, visualisation, reporting and storage of data in SAP HANA databases, optimization for performance and compliance with the contracting requirements, and integration of data between the cloud ERP environment and other IT systems, • quality control of the implemented/migrated ERP environment at least in the area of optimal data flow between the system areas, and in the case of migration data, their correctness, • implementation of best practices recommended by the Software Manufacturer and data migration tools to SAP S/4 HANA implemented in cloud technology, c) the skills necessary to obtain a certificate confirming knowledge and competence in the design of the SAP HANA database structures, confirmed by an appropriate certificate, issued by an entity independent of the Contractor or other equivalent document (as another document referred to in the above sentence is not permitted by the Contractor or related entity within the meaning of Article 108(1) of the PZp Act). 4. minimum 1 (one) person to serve as Technical Quality Expert who has: (a) minimum 5 years of professional experience understood as participating in the implementation of IT projects involving the provision of implementation or migration advisory services to SAP S/4 HANA or implementation or migration services to SAP S/4 HANA, (b) experience in the role of Expert on.

Note: In the case of Contractors jointly applying for the award of the above condition, if the total number of members of the dedicated team with the qualifications and experience of the consortiums together confirms the requirements of the above condition. Where the Contractor relies on the technical or professional capacity of the entities providing the resources, the above-mentioned SWI condition shall be deemed to be fulfilled if the total number of members of the dedicated team with the qualifications and experience of the Contractor and the entities providing the resources confirms the requirements resulting from the above-mentioned condition of participation.
