Renewal of Salesporce CRM software subscriptions

Requirement 1: Registration in the business register Economic operators participating in the procedure shall be legally constituted and registered in accordance with the legal provisions of the country of residence. Method of implementation: • Romanian legal / natural persons: Reminder certificate issued by ONRC, according to Law no. 265 / 2022, with real / actual information at the time of presentation • Foreign legal / physical persons: equivalent documents issued in the country of residence, certified in Romanian Legislative note: Art. 186 of Law No 99 / 2016: the ability to exercise professional activity shall be demonstrated by registration in the trade register or equivalent business registers. Article 186 (1) The contracting entity shall have the right to require any economic operator to submit relevant documents proving the form of registration and, where applicable, attestation or professional membership in accordance with the legal requirements of the country in which the economic operator is established. 2. In the procedures for the award of sectoral service contracts, where it is necessary for economic operators to hold a special authorisation or to be members of a particular organisation in order to be able to provide the services concerned in the State of origin, the contracting entity shall have the right to require them to demonstrate that they hold such authorisation or that they are members of such an organisation.

Request no. 1. Annual turnover. A minimum level of overall turnover is required. The average overall turnover over the last 3 financial years, namely 2023, 2024 and 2025, must be at least EUR 1.000.000. As preliminary evidence for the verification of the economic and financial situation, Economic Operators (Bidder, member of an Association, Supplying Third Party) must present a statement on their own responsibility. The self-declaration is represented by the DUAE Form. The DUAE Form will be completed and deposited in SEAP, according to Section IV.4.3.- Presentation of the Offer. Economic and financial capacity is identified in Part IV: Selection criteria, section B of DUAE "Economic and Financial Situation" - "Annual average turnover." Information on annual average turnover will be presented in the currency of the [RON] procedure. For monetary equivalence, the average exchange rate valid for each year shall be used in part published by the NRB. NOTE: If the tenderer: (1) is an Association of Economic Operators, (2) proposes supporting Tert, one DUAE will be completed and deposited in SEAP by each of them, under the conditions described above. Prior to the award of the contract, the contracting entity will request the highest bidder after applying the award criterion, the supporting documents proving those declared in the DUAE. The supporting documents (support) shall include, without limitation: 1. Accounting balance sheets for at most the last 3 financial years available (2023, 2024 and 2025) or financial statements (statements of balance sheets - profit / loss account) resulting from the business figures; 2. Any other supporting document relevant for demonstrating the qualification requirement, if, for objective and justified reasons, the tenderer (individual bidder, each member of an Association or Tert Supporter) is unable to provide the documents described in item 1; 3. In the case of the tenderers (individual bidder, member of an association, third supporter), legal / natural persons the documents will be transmitted in the language in which they were issued, accompanied by a translation of them into Romanian.

Requesting no. 1. Similar experience the tenderer (Tenant, member of an Association, Supporter Third Party) must provide proof that, in the last 3 years reported on the deadline set for the submission of tenders, he has provided services similar to those described in the specifications, under one or more contracts. Similar services shall mean the provision and / or making available of cloud / SaaS software subscriptions, for CRM solutions or other enterprise software solutions provided under SaaS, including, where applicable, the standard services associated with subscriptions, as provided by the manufacturer or other service providers / software subcrypts similar to those mentioned above, of similar or superior complexity in terms of complexity and / or purpose. The experience presented shall demonstrate the Bidder's ability to ensure the provision and activation of software subscriptions, the maintenance of rights of use during the contractual period and, where appropriate, access to their associated standard services. In order to demonstrate similar experience, it is not necessary to acquire the experience presented exclusively for the Salesorce platform, provided that the subject matter of the contracts submitted is comparable to the subject matter of this procurement in terms of nature, complexity and level of responsibility assumed. For the contracts submitted, the tenderer shall indicate at least: the subject matter of the contract, the beneficiary, the period of running, the value of the contract and the relevant activities / products for demonstrating similar experience. Similar experience can be demonstrated by one or more contracts without requiring all experience to come from a single contract. Method of implementation: • COMPLETE DUAE - Selection criteria section, Chapter C, with: number and date of contract, beneficiary, date of reception, share of activities and value, without VAT. • At the request of the contracting entity, the following shall be presented: record-finding certificates, reception minutes, recommendations, copies of relevant parts of the contracts fulfilled.

Request no. 2- Information on subcontracting. (DUAE - Part IV, Section C) Method of delivery: To be completed directly in SEAP, the Single European Procurement Document (SIAE). With DUAE, the Association Agreement will also be submitted according to Form 4a. Request no. 3 - Information on the association - if applicable - (DUAE - Part II, Section A) Method of fulfilment: To be completed directly in SEAP, the Single European Procurement Document (SIAE). DUAE will be completed by each associate bidder. With DUAE, the Association Agreement will also be submitted according to Form No 4b. The members of the association assume the obligation for the joint offer and are jointly responsible for the execution of the sectoral contract. At the conclusion of the contract, the Association Agreement will be presented in original / certified copy and will be the annex to the contract. Associates shall denounce from among themselves the one who, in the event of awarding the sectoral contract, represents them in relations with the Contracting Entity as the head of the Association. The supporting documents proving the commitments / agreements will be presented by the highest bidder in the intermediate ranking at the request of the contracting entity. Method of delivery: To be completed directly in SEAP, the Single European Procurement Document (SIAE). DUAE will be completed by each supporting third party, according to Article 202, Paragraph 2 of Law 99 / 2016, with subsequent amendments and completions. Request no. 5 Information on the Supplying Third Party - where applicable the Contracting Entity is required to take this support into account as evidence of the fulfilment of the minimum criteria required in the award documentation, if the following conditions are met cumulatively: a) the Supplying Third Party (s) may prove that they have the resources invoked as an element of support to the tenderer / candidate; b) the tenderer can demonstrate that it will effectively dispose of the resources of the supporting entities necessary for the performance of the contract, if the supporting third party is not declared a subcontractor. DUAE will be completed by each supporting third party, according to Article 202, Paragraph 2 of Law 99 / 2016, with subsequent amendments and completions. With DUAE, economic operators who demonstrate their technical and professional capacity by supporting a third party will also present a Support Commitment (Form 4c and Appendix) from it, confirming that they will provide the tenderer with the technical and professional resources invoked. The supporting documents proving those assumed in the agreements / commitments will be requested only to the highest bidder in the ranking resulting from the completion of the evaluation of offers.

Application No 1-Quality Management System Providers shall demonstrate that they have implemented a quality management system according to the standard SR EN ISO 9001 edition in force or equivalent, applicable to the field of activity relevant to the subject-matter of the contract, by submitting valid certificates issued by accredited national or international certification bodies, or other evidence / evidence / equivalent documents. The certification or equivalent measures submitted shall be relevant for activities related to the provision, provision and / or administration of cloud / SaaS software services. Where the ISO 9001 certificate submitted does not expressly cover the activities related to the subject-matter of the contract, the tenderer shall provide additional information / documents resulting from the applicability of the quality management system to the activities relevant to this contract.
