Services for the development, testing and piloting of digital solutions, including training of staff involved in operating / managing digital solutions

The DUAE shall be completed with YES or NO by economic operators (individual tenderer / associate tenderer / subcontractor proposed) participating in the award procedure with the information related to their situation in accordance with Article 193 (1) of Law No 98 / 2016, taking into account the obligation of the contracting authority provided for in Article 193 (6) of the same legislative act to select in DUAE "α: global indication for all selection criteria." The contracting authority shall request as provided for in Article 132 (2) of HG No 395 / 2016 the following supporting documents proving the fulfilment of those assumed by the completion of the DUAE: 1. the certificate of establishment and / or, where applicable, the instrument of incorporation which must certify that the economic operator belongs to the professional category required by the performance of the contract, that is to say, to the subject matter of the public procurement. This document must also reflect the structure of the shareholder / members of the economic operator. The information shall be real / valid at the date of presentation; 2. the document issued by the National Office of the Trade Register (O.N.R.C.) pursuant to Article 56 of Law No 129 / 2019. The statement submitted shall certify the beneficial ownership of the legal person and the way in which the control is exercised. 3. the forms provided by the contracting authority; 4. other edifying documents, as appropriate. Foreign economic operators will submit documents in accordance with Article 168 of Law No 98 / 2016.

The minimum annual turnover of the tenderer for the last three financial years available, respectively for the years 2023, 2024, 2025, shall be at least equal to: 3,500,000 lei MODALITY OF COMPLETION: The DUAE shall be supplemented by YES or NO by economic operators (individual tenderer / associate tenderer / subcontractor proposed / supporting third party) participating in the award procedure with the information related to their situation in accordance with Article 193 (1) of Law No 98 / 2016, taking into account the obligation of the contracting authority referred to in Article 193 (6) of the same normative act to select in the DUAE "α: global indication for all selection criteria." The contracting authority shall request as provided for in Article 132 (2) of HG No 395 / 2016 the following supporting documents proving the fulfilment of those assumed by the completion of the DUAE: 1) balance sheets or balance sheets, financial audit reports; 2) other edifying documents issued by specialised bodies confirming the level of turnover entered in the DUAE, as appropriate. 3) where appropriate, the firm commitment of the supporter (see the indicative model provided by the contracting authority in the form section), as well as the documents submitted to the tenderer by the supporter third party, resulting in the effective way in which he will ensure that the undertaking is fulfilled, documents which will be attached to that undertaking; In order to demonstrate that the minimum requirement on economic and financial capacity is met, any bidding economic operator shall be entitled under the law to: 1. jointly participate with other economic operators in the award procedure, under the terms of Article 53 of Law No 98 / 2016. 2. invoke the support of a third party and use its capacities to meet the minimum requirement, irrespective of the nature of the legal relationship between the bidder and the entity whose capacity it uses, under Article 182 of Law No 98 / 2016; Foreign economic operators will submit documents in accordance with Article 168 of Law No 98 / 2016. Documents issued in another language shall be presented together with the authorised translations in Romanian. For a uniform assessment of how the requirement is met, for documents presented in another currency, the calculation of equivalence will be applied to the average annual rate of lei / currencies communicated by the National Bank of Romania for each year.

The tenderer shall specify the part (s) of the contract to be subcontracted and the recognition dates of the proposed subcontractors (if applicable). The subcontractor's name and contact details, the part (s) of the contract to be fulfilled by them, the percentage of the contract to which the respective party (s) are assigned shall be completed by DUAE. The subcontracting agreement (see indicative model provided by the contracting authority in the form section) shall be submitted with the DUAE by all economic operators, as provided for in Article 193 (3) of Law No 98 / 2016.

The tenderers must demonstrate that, in the last 3 years (calculated by the deadline set for the submission of tenders), they have provided and completed similar services as follows: The bidders must demonstrate that they have provided and completed similar services under at least one contract, but not more than three contracts, with a cumulative total value, excluding VAT, of at least 50% of the estimated value of the respective acquisition 894,672.12 lei without VAT. Similar services include: a) development and / or exploitation in live / production of an electronic portal for external users (citizens, beneficiaries, partners, customers); b) development and / or exploitation in live / production of a DMS system / electronic registry / management documents and flows; c) integration between frontoffice modules (e.g. portal, external applications) and administrative / back-office flows. Experience can be proven by one or more different contracts a) development and / or exploitation in a live-in / production of an electronic portal for external users (citizens, beneficiaries, partners, customers); b) development and / or exploitation in live-in / production of a DMS system / electronic registry / management documents and flows; c) integration between frontoffice modules (e.g. portal, external applications) and administrative / back-office flows. Experience can be proven by one or more different contracts. Where the contracting authority is required, for whatever reasons, to delay the deadline set for submission of tenders, the lower limit of the 3-year period shall be extended by the time period corresponding to the gap and the requirement for all operators who have submitted proof that the similar experience contract has been concluded within the new time period. Beneficiaries of services may be from the public or private sector. The contracts / other equivalent documents submitted shall bear at least: the identity of the parties, the subject matter of the contract, the type and value of the services provided, the period of running. Where the economic operator has been subcontractor in the contract presented as a similar experience, he shall submit documents confirming the performance of the services and the final beneficiary of the contract attesting that the economic operator has been subcontractor. If the economic operator demonstrates its technical and professional capacity by invoking and supporting the third party (according to Art. 182- 184 of Law No. 98 / 2016, as amended and completed) then it is required to prove its support by submitting a firm commitment to the person concerned (see the indicative model provided by the contracting authority in the form section).
