1. Contract award may be sought by economic operators who: (1) are not excluded from the procedure; (2) fulfil the conditions for participation in the procedure laid down by the contracting authority in the contract notice and this SWI. 2. The conditions for participation in the procedure concern: 2.1. the ability to trade The Contracting Authority shall not determine the condition in this respect. 2.2. the right to pursue a particular economic or professional activity, where this results from separate provisions The Contracting Authority shall not determine the condition in this respect. 2.3. the economic or financial situation The Contracting Authority shall not determine the condition in this respect. 2.4. technical or professional capacity The Contracting Authority shall not determine the condition in this respect. 3. The Contracting Authority shall exclude from participation in the proceedings of the Contractor (subject to Article 110(2) of the Act Pzp), in the case of the following circumstances: 1. in Article 108(1) of the Pzp Act, (2) in Article 109(1) to (4) of the Pzp Act, (3) in Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in relation to Russian actions destabilising the situation in Ukraine (OJ L 229, 31.07.2014, p. 1), as amended by Council Regulation (EU) No 2025/2033 amending Regulation (EU) No 833/2014 concerning restrictive measures in relation to Russia's actions destabilising the situation in Ukraine (OJ L 202, 2025/2033 of 23 October 2025). 4) in Article 7(1) of the Act of 13 April 2022 on special solutions to countering the promotion of aggression against Ukraine and to protect national security (Journal of Laws of 2025 item 514). 4. The exclusion of the contractor shall take place in accordance with Article 111 Pzp and its tender shall be rejected under Article 226(1)(a) of that Act. 5. If the contractor relies on the capacity or situation of the entities making the resources available, the contracting entity shall examine whether there are grounds for exclusion which have been provided for the contractor. 6. In the case of joint procurement of economic operators, the contracting authority shall examine whether there are grounds for exclusion against each of these economic operators.
