Economic operators submitting the offer must prove a form of registration under the conditions of the law of the country of residence, to reiterate that the economic operator is legally constituted, that it is not in any of the situations of cancellation of the constitution and that it has the professional capacity to perform the activities covered by the contract.
How to demonstrate compliance with the requirement: the D.U.A.E. will be completed by economic operators participating in the award procedure with information related to their situation. The supporting documents proving the fulfilment of those assumed by the completion of the D.U.A.E. shall be submitted, at the request of the contracting authority, only by the highest bidder in the intermediate ranking drawn up on completion of the evaluation of tenders. Documents requested:
- for Romanian legal entities: - certificate issued by the Trade Register Office;
- for foreign legal entities: - edifying documents proving a form of registration as legal person or of registration / attestation or professional membership, in accordance with the legal provisions of the country in which the tenderer is resident. The documents will be presented together with their authorised translation into Romanian. In the case of an association, each associate shall provide these documents.As the documents will be requested from the highest bidder, they will be valid at the time of submission. Failure to submit such documents shall lead to the exclusion of the tenderer from the proceedings.

Punctajul se acordă în acord cu cerințele minime C127, C128 și C129 enunțate în Anexa nr. 1 la Caietul de sarcini. Algoritm de calcul: a) Pentru ofertele conforme din punct de vedere tehnic, care oferă o durată a garanției și suportului tehnic de 24 luni se oferă 0 puncte; PFact1oferta analizata = 0 b) Pentru ofertele conforme din punct de vedere tehnic, care oferă o durată a garanției și suportului tehnic de 36 luni se oferă 10 puncte; PFact1oferta analizata = 10 c) Pentru ofertele conforme din punct de vedere tehnic, care oferă o durată a garanției și suportului tehnic de 48 luni se oferă 20 puncte; PFact1oferta analizata = 20 Punctajul se acordă exclusiv pentru cicluri complete de câte 12 luni, calculate peste durata minimă obligatorie de 24 de luni. Nu se acordă punctaje intermediare sau proporționale. În cazul în care durata ofertată de garanție și suport tehnic nu corespunde unui ciclu complet de 12 luni, punctajul se acordă prin raportare la ultimul ciclu complet îndeplinit. Astfel, o garanție mai mare de 24 de luni, dar care nu atinge 36 de luni, primește 0 puncte, iar o garanție mai mare de 36 de luni, dar care nu atinge 48 de luni, primește 10 puncte. Pentru o garanție mai mare de 48 de luni nu se acordă punctaj suplimentar, aceasta urmând să primească punctajul maxim de 20 de puncte.
