(1) Evidence and declarations of suitability according to §§ 45, 46 VgV and §§ 123, 124 GWB according to form VHB 124 LD (turnover of comparable services of the last three financial years, references on comparable services of the last three years, workforce, professional register registration, insolvency proceedings, liquidation, no serious misconduct, commercial central register extract, payment of taxes and duties as well as social security contributions, professional association). In order to take into account references on comparable services, the following aspects are used in particular compared to the advertised service: type of action, volume of orders, duration of execution, technical and device-specific requirements, equipment (personnel, machinery) with sufficient availability, manner and particularities of execution. Specifications in this regard may result from the award documents. In addition, according to § 6 WRegG, the awarding authority will request an extract from the Competition Register from the Federal Cartel Office. (2) Self-declarations on compliance with ILO core labour standards with Form 004 Stadt-FR and EU sanctions against Russia with Form 010 Stadt-FR. These declarations shall be deemed to have been declared and signed by the tenderer upon submission of a tender. Members of a group of tenderers or subcontractors must sign the declarations. (3) In the case of intended subcontracting assignment, the nature and extent of the subcontracting services must be specified by submitting an offer (form VHB 235). Upon request at the latest, the following must be submitted: the names of the subcontractors, the proof of the subcontractor’s suitability (for fulfilling the suitability requirements or in accordance with the required proof of the tenderer) and a declaration of commitment by the subcontractor that the necessary capacities are available in the case of a contract and that joint liability is assumed in the case of a suitability loan (Form VHB 236). (4) In the case of an intended group of bidders (BG): declaration stating the members, the managing member who legally represents the BG and the declaration that all members are jointly and severally liable (form VHB 234). The suitability requirements must in principle be met by the BG as a whole, unless the template according to Form 001 Stadt-FR (detection list UVgO/VgV) shows otherwise. The listed documents, declarations and evidence shall be submitted by means of self-declarations, pre-qualifications or certificates. The Single European Self-Declaration (EEE) is also accepted if the required information is included. The customer reserves the right to have self-declarations proven by corresponding proof. For foreign companies, equivalent proof of eligibility is allowed. The forms provided shall be used. The proofs shall be submitted as far as possible with the submission of a tender or at the latest at the request of the contracting entity.
