  1. Subject of the order The subject of the order is the delivery of server equipment for the Provincial Hospital of Zofia Zamoyski Tarnowska in Tarnobrzeg.
  2. Description of order
    1. CPV code according to Common Procurement Dictionary: 48822000-6 – Computer servers 30233000-1 – Data storage and reading devices
    2. Detailed description of the subject of the order contains Annex 2 to the SWZ – Description of the object of the order together with the price form.
    3. Where, in the content of the tender documents, the description of the subject-matter of the contract uses records indicating the trademarks, patents or origin of the product, the source or specific process which characterises the products or services supplied by a particular Contractor, they shall be treated as examples only, in which case they shall be regarded as examples only.The Contracting Authority shall allow the submission of equivalent tenders.The Contracting Authority shall indicate that the submission of equivalent tenders is acceptable provided that the object offered is as functionally and as closely as possible in terms of design, materials from which it is made, sizes, etc. to sample products, and the Contracting Authority shall demonstrate in the offer that the object offered has technical - operational - usable characteristics not worse than the parameters indicated in the following annex of the subject-matter of the contract.Any risk (including the cost of any expertise) associated with proving equivalence shall be borne by the Contractor. An equivalent offer shall be understood to include a tender which describes the subject matter of the contract with at least the same or better parameters as defined in the WWZ, but marked, for example, by another trade mark, patent or origin.The offer shall be equivalent to products or solutions which correspond to or exceed in terms of quality and functionality the products or solutions indicated by the contracting authority in the SCI and shall not reduce them. The Contractor making an equivalent offer is obliged to prove the equivalence of the products or solutions offered. The mentioned names of producers (if any) in the documents were used for example only.Alternatively, the names indicated and their producers are not intended to infringe the principle of fair competition and equal treatment of economic operators. Wherever indicated, the term ‘or equivalent’ shall be read as such.By the term ‘or equivalent’ The Contracting Authority understands the provision of materials to ensure the performance of the task ensuring that the technical parameters are not less than those laid down in the above documents.The application of equivalent solutions shall not lead to a deterioration of the characteristics of the subject-matter of the contract in relation to the contract documents, nor to a change in price or to a breach of the law.
    4. In any case, the use in the description of the subject matter of the procurement of standards, technical assessments, technical specifications and technical reference systems referred to in Article 101(1)(2) and (3) of the Public Procurement Act, The contractor should assume that such a reference is accompanied by the words ‘or equivalent’.
    5. The contractor is responsible for quality, compliance with technical and quality conditions described for the subject matter of the order.
    6. The rules for the execution of the contract in question are set out in the ‘Project Agreement’ which is attached to Annex 4 to the WWZ.
