Method of compliance for all requirements: Initially, the economic operator will complete with "YES 'or" NO' in DUAE in view of the provisions of Art. 193 para. (6) of Law No 98 / 2016 Requirement 1 Bidding economic operators must prove a form of registration under the law of the resident country, showing that the economic operator is legally constituted, is not in any of the situations of cancellation of the constitution, and that it has the professional capacity to perform the activities covered by the public / sectoral contract. The requirement shall also apply to subcontractors who supplement information related to their situation at the level of a distinct DUAE. The supporting document proving the fulfilment of those assumed by the completion of the DUAE, i.e. the finding certificate issued by the ONRC, or in the case of foreign legal / natural tenderers, the equivalent documents issued in the country of residence, translated into Romanian, are to be submitted, at the request of the contracting authority / entity, only by the highest bidder in the intermediate ranking drawn up on completion of the evaluation of tenders. Where parts of the contract will be executed by subcontractors, proof of registration and correspondence of the main / secondary activities within the contract with the object of the acquisition will also be required by subcontractors for the part of the contract they will perform. The supply activity cannot be subcontracted in the light of Article 3 paragraph (1) letter yy) of Law No 98 / 2016 - "subcontractor / sub-contractor - any economic operator which is not part of a public procurement contract and performs certain parts or elements of the works / services, responsible to the contractor for the organisation and conduct of all stages necessary for that purpose. The provision of equipment or the supply of materials / goods under a public contract shall not be considered as subcontracting for the purposes of this Law.

Tenderers and subcontractors are obliged to complete F 8: Declaration of own responsibility regarding the beneficial owners of the funds, attached to this documentation. At the evaluation stage of the supporting documents DUAE, the highest bidder will be required to submit for compliance: According to art. 3, paragraph 1, letter a, b, c, d of instruction 6, Revision 2 of 07.06.2023 on obtaining data and information on the exante verification of the actual recipient of funds from the PNRR for public procurement procedures, as follows: a) for tenderers whose shareholders are natural persons or legal persons registered in Romania, an ONRC extract will be submitted. b) for the tenderer / tenderers declared to be the winner (i) has / have in the shareholders structure foreign legal entities, the contracting authority shall collect from the tenderer a self-declaration given by the legal representative, as provided for in Article 326 of the Criminal Code on false declarations, which shall contain the data on the beneficial owners of foreign legal entities (at least the name, surname and date of birth), in accordance with Law 129 / 2019, with subsequent additions and amendments. c) for foreign bidders registered outside Romania, they will submit supporting documents, certificates or other documents issued by the authority responsible for the data of the actual beneficiary in the country of the tenderer, together with the translation into Romanian, certified by authorised translators, under the conditions of the law. d) for tenderers such as associations and foundations, the contracting authority shall collect from them an extract from the Ministry of Justice (National NGO Registry) on the beneficial owners of the association / foundation; where the association / foundation is a foreign entity or has real beneficiaries of foreign persons, the contracting authority shall collect from the tenderers a self-declaration given by the legal representative / president, as provided for in Article 326 of the Criminal Code on false declarations, which shall contain the data on the beneficial owners of legal entities (at least the name, surname and date of birth), in accordance with Law 129 / 2019, with subsequent additions.

Nivel(uri) minim(e) al(e) standardelor care ar putea fi impuse: Formula de calcul a indicatorului financiar: Ve x n/Dc = cash-flow, unde: Ve - reprezintă valoarea estimată; n - reprezintă perioada pentru care se solicită cash-flow (1/10 din termenul de livrare solicitat); Dc - termen de livrare solicitat. Perioada pentru care se solicită asigurarea cash-flow-ului: Lot 1: n = 30 zile/10 = 3 zile Indicator cash-flow: 43.272,72 lei x 3 zile / 30 zile = 4.327,27 lei;

Lot 2: n = 30 zile/10 = 3 zile Indicator cash-flow: 47.206,56 lei x 3 zile / 30 zile = 4.720,66 lei;

Lot 3: n = 30 zile/10 = 3 zile Indicator cash-flow: 55.074,36 lei x 3 zile / 30 zile = 5.507,44 lei;

Modalitatea de indeplinire: Inițial, operatorul economic va completa cu ”DA” sau ”NU” respectivul punct din partea IV fără să trebuiască să completeze nicio altă secțiune, respectiv secțiunile A, B, C sau D, având în vedere prevederile art.193 alin.(6) din Legea nr. 98/2016.

Ofertantul clasat pe locul I (asociat și/sau terțul susținător) trebuie să demonstreze ca la momentul solicitării documentelor suport DUAE va avea acces sau are disponibile resurse reale, negrevate de datorii, depozite bancare, linii de credit confirmate de bănci ori alte resurse financiare, suficiente pentru a realiza un cash flow de minimum valoarea Indicatorului precizat anterior, pentru perioada solicitată. Disponibilitatea va putea fi dovedită prin orice document relevant (linie de credit confirmată de o instituție de creditare, disponibilități bănești proprii, confirmate de bănci etc), angajant în raport cu emitentul, în sensul asigurării resurselor financiare pentru perioada solicitată. Suma va fi destinată exclusiv îndeplinirii viitorului contract încheiat cu Autoritatea contractantă, independent de alte angajamente contractuale ale operatorului economic. În cazul în care un operator economic demonstrează îndeplinirea criteriilor referitoare la situația economică și financiară invocând susținerea unui/unor terț/terți, autoritatea contractantă solicită ca operatorul economic și terțul/terții susținător/susținători să răspundă în mod solidar pentru executarea contractului de achiziție publică. Răspunderea solidară a terțului/terților susținător/susținători se va angaja sub condiția neîndeplinirii de către acesta/aceștia a obligațiilor de susținere asumate prin angajament.
