1 Information and formalities necessary to assess compliance with those requirements: The DUAE shall be completed by the economic operators participating in the award procedure with the information related to their situation. 2 Methods of execution: The contracting authority shall require that economic operators submitting tenders (individual tenderer / associate tenderer / proposed subcontractor / supporting third party) prove a form of registration under the law of the country of residence, showing that the economic operator is legally constituted, the structure of its shareholder / members, that it is not in any of the situations of cancellation of the constitution, and that it has the professional capacity to carry out the activities covered by the contract.

The contracting authority shall require the submission of a document issued by the National Trade Registry Office stating that the subject matter of the contract is related in the C.A.E.N. Code. - for foreign legal / natural persons: documents proving a form of registration / attestation or professional membership.

The documents will be presented together with the authorised translation in Romanian. - the certificate must certify that the company belongs to the professional category required by the performance of the contract and has an activity corresponding to the object of the procurement. - the information contained in the certificate must be true / valid at the date of presentation. - the certificate shall be presented by the tenderer or the tenderer, if any, associated to the part of the contract which he performs.

The supporting documents proving the fulfilment of those assumed by the completion of the DUAE are to be submitted at the request of the contracting authority, only by the highest bidder in the ranking drawn up following the application of the award criterion as provided for in Article 132 (2) of the Rules are:

The document issued by the ONRC that the contracting authority will obtain by questioning the ONRC database under Protocol No 308.813 / 23.06.2017, thereby reducing the administrative effort required to be submitted by tenderers. In the case of foreign persons, documents proving the requirement similarly will be presented. The documents will be presented together with the authorised translation in Romanian.
The document issued by the National Office of the Trade Register (N.R.C.) pursuant to Article 56 of Law No. 129 / 2019 to prevent and combat money laundering and terrorist financing and to amend and supplement certain normative acts, with subsequent amendments and additions. The statement submitted shall certify the beneficial ownership of the legal person and the way in which the control is exercised. In the case of foreign persons, documents proving the requirement similarly will be presented. The documents will be presented together with the authorised translation in Romanian.

1 Information and formalities necessary to assess compliance with those requirements: The DUAE shall be completed with the names of the subcontractors and their contact details, the part (s) of the contract to be fulfilled by them, the percentage of the contract to which the respective party (s) are to be held. 2 Methods of execution: The subcontracting agreement will be submitted with DUAE by all economic operators, as provided for in Article 193 (3) of Law No 98 / 2016.

1 Information and formalities necessary for evaluating compliance with the stated requirements: The ESPD shall be completed in accordance with ANAP Notification no. 240/2016 corroborated with ANAP Notification no. 1/2021 regarding the possibility of completing the ESPD conferred by Commission Implementing Regulation (EU) 2016/7 of 5 January 2016 establishing the standard form for the European Single Procurement Document.

The tenderer (economic operator or members of the association of economic operators together) must demonstrate similar services provided in the last 3 years, calculated from the deadline for the submission of tenders, showing that it has provided services similar to those subject to the award procedure for which the tender is submitted across a minimum of 1 contract and a maximum of 5 contracts, with a cumulative value of at least RON 27,000,000.00 excluding VAT, indicating the values, dates, and public or private beneficiaries.

The values of similar experience will be converted from euros at the average leu/euro exchange rate published by the National Bank of Romania for the respective year. Tenderers who need to convert currencies other than the euro shall use the average annual exchange rates established by the European Central Bank. Similar/comparable projects/contracts shall mean projects/contracts whose object was software development services for the development of a new IT system or the extension of an existing IT system.

The extension of an IT system means the development and implementation of new functionalities or the updating of functionalities for an existing IT system.

Within this award procedure, in the understanding of the contracting authority, for the evaluation of similar experience, the concept of project/contract refers to the existence of a legally regulated framework through which an economic operator has carried out in a consistent manner (having a well-defined and achieved purpose) the type of services that are of interest for evaluation.

The method of calculating the 3-year period will correspond to any postponements of the deadline set in the initially published contract notice, meaning that if the tender submission deadline is postponed, the period related to similar experience will be extended accordingly (by the postponed days). The values of similar experience will be converted from euros at the average leu/euro exchange rate published by the National Bank of Romania for the respective year.

Tenderers who need to convert currencies other than the euro shall use the average annual exchange rates established by the European Central Bank. 2 Methods of fulfillment: The supporting documents proving the fulfillment of the commitments made by completing the ESPD are to be submitted upon the contracting authority's request, only by the tenderer ranked first in the intermediate ranking established following the application of the award criterion, in accordance with the provisions of Art. 132 para. (2) of the Rules.

These documents may be: certificates / contracts / relevant documents / acceptance certificates / recommendations, etc. issued or countersigned by the beneficiaries of the products, showing compliance with the above conditions and the fact that the services were performed in accordance with contractual obligations. Beneficiaries of the services may be from the public or private sector. The documents must be submitted in Romanian or accompanied by a Romanian translation carried out by an authorized translator.

In order to demonstrate compliance with the minimum requirement regarding similar experience, any tenderer economic operator has the right: 1. to invoke third-party support, including when the third party also acts as a subcontractor, and to use its capacities to satisfy the minimum requirement, regardless of the nature of the legal relationships between the tenderer economic operator and the entity whose capacities it uses, under the terms of Art. 182 of Law no. 98/2016;…
