The DUAE shall be completed by the economic operators participating in the award procedure with the information related to their situation. The unique tenderer / Associated tenderer / Subcontractor will complete the DUAE - section "Selection criteria '- point A" Global indication for all selection criteria'. As regards the "Selection criteria '- point A" Global indication for all selection criteria', the contracting authority shall require the single tenderer / associate tenderer / subcontractor to declare whether or not it meets all the selection criteria set out in the procurement documents and referred to in the contract notice. The contracting authority shall require that economic operators submitting tenders (individual tenderer / associate tenderer / subcontractor proposed) prove a form of registration under the law of the country of residence, showing that the economic operator is legally constituted, the structure of its shareholder / members, that it is not in any of the situations of cancellation of the constitution, and that it has the professional capacity to carry out the activities covered by the contract. The contracting authority shall require the submission of a document issued by the National Trade Registry Office (N.R.C.) stating that the subject matter of the contract is corresponding in the C.A.E.N code. The certificate must certify that the company belongs to the professional category required by the performance of the contract and has an activity corresponding to the subject matter of the procurement. The information contained in the certificate shall be real / valid at the date of presentation. The finding certificate will have to be submitted by the tenderer or associate tenderer, where appropriate, for the part of the contract he performs. Foreign legal / natural persons will present documents proving a form of registration / attestation or professional membership. The documents will be presented together with the authorised translation in Romanian. The supporting documents proving the fulfilment of those assumed by the completion of the DUAE shall be submitted at the request of the contracting authority, only by the highest bidder in the intermediate ranking drawn up following the application of the award criterion, as provided for in Article 132 (2) of the Rules.

The ESPD shall be completed in accordance with ANAP Notification no. 240/2016 corroborated with ANAP Notification no. 1/2021 regarding the possibility of completing the ESPD conferred by Commission Implementing Regulation (EU) 2016/7 of 5 January 2016 establishing the standard form for the European Single Procurement Document. Information and formalities necessary for evaluating compliance with the aforementioned requirements: The tenderer (economic operator or members of the association of economic operators together) must provide proof of similar services performed in the last 3 years, calculated from the deadline for the submission of tenders, showing that it has provided services similar to those subject to the contract for which the tender is submitted across a maximum of 3 (three) contracts/projects, with a cumulative value of at least 10,000,000.00 Lei excluding VAT, indicating the values, dates, and public or private beneficiaries. The calculation method of the 3-year period will correspond to any postponements of the deadline provided in the initially published contract notice; thus, if the tender submission deadline is postponed, the period related to similar experience will be extended accordingly (by the postponed days). By "similar/comparable contracts/projects" are meant contracts/projects that had as their object software development services and the commissioning/deployment of IT systems/applications. To fulfill this requirement, the demonstrated experience must include contracts/projects with components intended for use on mobile devices and/or contracts/projects with components accessible via web browser in a desktop environment. Projects whose exclusive object was the installation, configuration, parameterization, administration, or use of existing applications are not considered similar. Similar experience values will be converted from EUR at the average RON/EUR exchange rate published by the National Bank of Romania for the respective year. Tenderers that need to perform the conversion of currencies other than EUR will use the average annual exchange rates established by the European Central Bank. Means of fulfillment: The sole tenderer/associated tenderer/supporting third party/subcontractor will fill in the ESPD – Section "Selection Criteria" – item A "Global indication for all selection criteria". Regarding "Selection Criteria" – item A "Global indication for all selection criteria", the contracting authority requests the sole tenderer/associated tenderer/supporting third party/subcontractor to declare whether or not it meets all selection criteria established in the procurement documents and mentioned in the contract notice. Supporting documents proving the fulfillment of what has been undertaken by completing the ESPD are to be submitted upon the contracting authority's request, only by the tenderer ranked first in the intermediate ranking drawn up following the application of the award criterion, pursuant to the provisions of art. 132 para. (2) of the Norms. These documents may include: acceptance minutes/performance certificates/recommendations/other relevant documents issued or countersigned by the beneficiaries of the services from the contracts invoked as similar experience, regardless of whether the beneficiaries are public authorities or private clients. Supporting documents must contain information showing: a) the fact that the services provided are similar, b) the beneficiary of the provided services, c) the period during which the services were provided, d) the value of the provided services, e) the fact that the services were accepted within the aforementioned 3-year period, f) the fact that the services were performed in accordance with the contractual obligations. Foreign economic operators will submit the same type of documents as requested above. Information and formalities necessary to assess compliance with those requirements: The DUAE shall be completed with the names of the subcontractors and their contact details, the part (s) of the contract to be fulfilled by them, the percentage of the contract to which the respective party (s) are to be held. Methods of compliance: The subcontracting agreement will be submitted with DUAE by all economic operators, as required by Article 193 para. (3) of Law no. 98 / 2016.
