What the buyer wants
- The subject of the contract is the service of access to selected resources of the Elsevier publishing house in the online version from 01.01.2027 to 31.12.2027, directly from work stations and servers and via HAN – Hidden Automatic Navigator (H+H Software GmbH). The contractor will ensure that the publisher (Elsevier), University of Silesia, is identified on the server as a separate user.The identification criterion will be IP addresses of the University of Silesia in Katowice (including the Science Information Centre and Academic Library in Katowice): IP: 155.158.0.0 mask: 255.255.0 (155.158.0.0/16). The above-mentioned releases have access to the maximum number of simultaneous users that the publisher defines, directly from workstations and servers and via HAN – Hidden Automatic Navigator (H+H Software GmbH).FTE US is 21156.2) The scope of the order includes access to 6 publications by the platform ScienceDirect released by Elsevier. The subject matter of the contract includes access to as many publications as specified in the SWZ, as during the duration of the contract, i.e. from 01.01.2027 from 31.12.2027, appeared, taking into account all publications dated for that period regardless of the date of their issue. Access by the ScienceDirect platform of Elsevier publishing house.
- Access will be provided by subscription from 01.01.2027 to 31.12.2027. The activation time of access to the database shall not be longer than 5 working days from the date of conclusion of the contract.

- W celu potwierdzenia, że osoba działająca w imieniu Wykonawcy jest umocowana do jego reprezentowania, Zamawiający żąda od Wykonawcy: odpisu lub informacji z Krajowego Rejestru Sądowego, Centralnej Ewidencji i Informacji o Działalności Gospodarczej lub innego właściwego rejestru. Dokument składany wraz z ofertą.
- Jeżeli w imieniu Wykonawcy działa osoba, której umocowanie do jego reprezentowania nie wynika z dokumentów, o których mowa w pkt 1, Zamawiający żąda od Wykonawcy złożenia: pełnomocnictwa lub innego dokumentu potwierdzającego umocowanie do reprezentowania wykonawcy. Wymóg powyższy ma zastosowanie odpowiednio do osoby działającej w imieniu wykonawców wspólnie ubiegających się o udzielenie zamówienia publicznego.
- Dokumenty, o których mowa w pkt 1 i 2 składane są wraz z ofertą w formie elektronicznej (postać elektroniczna z podpisem kwalifikowanym), w postaci elektronicznej z podpisem zaufanym lub osobistym albo kopii w postaci cyfrowego odwzorowania dokumentu papierowego, której zgodność z oryginałem poświadcza odpowiednio wykonawca (w przypadku dokumentów z pkt 1) lub mocodawca (w przypadku dokumentów z pkt 2) lub notariusz podpisem kwalifikowanym.
- Zamawiający nie wezwie do złożenia podmiotowych środków dowodowych, jeżeli może je uzyskać za pomocą bezpłatnych i ogólnodostępnych baz danych, w szczególności rejestrów publicznych w rozumieniu ustawy z dnia 17 lutego 2005 r. o informatyzacji działalności podmiotów realizujących zadania publiczne, o ile wykonawca wskaże w oświadczeniu, o którym mowa w art. 125 ust. 1 ustawy Pzp, dane umożliwiające dostęp do tych środków.Podobnie w przypadku dokumentów, o których mowa w ust. 4 pkt 2 lit. a) o ile wykonawca wskazał dane umożliwiające dostęp do tych dokumentów; ; przy czym w zakresie odpisu lub informacji z Krajowego Rejestru Sądowego lub Centralnej Ewidencji i Informacji o Działalności Gospodarczej, Zamawiający przyjmie, iż dostatecznymi danymi umożliwiającymi dostęp do tych dokumentów w rozumieniu § 13 ust. 2 Rozporządzenia Ministra Rozwoju, Pracy i Technologii z dnia 23 grudnia 2020 r. w sprawie podmiotowych środków dowodowych oraz innych dokumentów lub oświadczeń, jakich może żądać zamawiający od wykonawcy, będą odpowiednio dane dotyczące nr KRS, NIP lub REGON wskazane przez Wykonawcę w formularzu oferty.
- Zgodnie z dyspozycją przepisu art. 273 ust. 2 ustawy Pzp, wykonawca dołączy do oferty: Oświadczenie wstępne, o którym mowa w art. 125 ust. 1 ustawy Pzp, w celu potwierdzenia braku podstaw do wykluczenia z postępowania, zgodnie z treścią załącznika nr 1B do SWZ. Wymagana forma i moment złożenia: Oświadczenie wstępne należy złożyć w formie elektronicznej (postać elektroniczna z podpisem kwalifikowanym), w postaci elektronicznej z podpisem zaufanym lub osobistym. Oświadczenie składane wraz z ofertą.
