Economic operators submitting a tender must prove a form of registration under the law of the country of residence, showing that the economic operator is legally established, is not in any of the situations of annulment of establishment, and has the capacity to deliver the products that are the subject of the contract. Means by which the fulfillment of the requirement can be demonstrated: the ESPD will be completed by the economic operators participating in the award procedure with the information relating to their situation. The supporting documents proving the fulfillment of the commitments made by completing the ESPD, namely the certificate of status issued by the ONRC, or in the case of foreign tenderers, equivalent documents issued in the country of residence, are to be submitted, at the request of the contracting authority, only by the tenderer ranked 1st in the intermediate ranking drawn up upon completion of the evaluation of the tenders. The information in the certificate of status must be true/valid on the date of its submission.

The minimum average overall turnover of the tenderer over the last 3 years (2023, 2024, and 2025) must be at least equal to 234,643.06 Lei. Method of fulfillment: The ESPD (European Single Procurement Document) shall be completed by the economic operators (tenderers/associated tenderers/third-party supporters) participating in the public procurement contract award procedure in section "a: Global indication for all selection criteria", in accordance with the provisions of Art. 193 para. (6) of Law no. 98/2016, by which economic operators declare whether or not they fulfill all the selection criteria set out in the procurement documentation. The following supporting documents proving the fulfillment of the requirement shall be submitted only by the tenderer ranked first in the intermediate ranking drawn up at the completion of the tender evaluation: balance sheets or extracts from balance sheets, financial audit reports, or other documents issued by specialized bodies confirming the turnover level. Association: If an Economic Operator (Tenderer) exercises its right to participate jointly with other Economic Operators in the award procedure, pursuant to Art. 54 of Law no. 98/2016, to demonstrate fulfillment of the minimum requirement, it must submit together with the tender, by the deadline for submission of tenders, the following: a. The association agreement; b. A separate ESPD (response) for each Economic Operator (individual Tenderer, Consortium members, Subcontractors, Third-Party Supporters) with which it participates jointly in the award procedure, completing the requested information in Part II (Sections A, B, and C) and Part III. For Part IV: Selection criteria, section "a: Global indication for all selection criteria" shall be completed, according to the provisions of Art. 193 para. (6) of Law no. 98/2016, by which economic operators declare whether or not they meet all selection criteria set out in the procurement documentation.

A list of the main product deliveries carried out in the last 3 years, containing values, delivery periods, and beneficiaries. The tenderer must provide proof of similar experience in delivering products that are technically similar. Product deliveries shall be confirmed by presenting certificates/documents issued or countersigned by an authority or by the beneficiary client. The respective copies shall be submitted with the mention "certified true copy of the original". Foreign legal entities shall attach copies of similar documents accompanied by a certified translation.
