Awarding of delivery, consulting and implementation services for the introduction and integration of waste management software for the district of Schmalkalden-Meiningen

Preliminary remark: Eligibility shall be demonstrated separately for each member of an applicant community. Unless otherwise provided for in the following, all evidence of suitability must therefore be submitted by each member of an applicant community. An applicant may rely on other undertakings to prove his or her suitability, irrespective of the legal nature of the links between him or her and that undertaking (eligibility loan).

This possibility exists regardless of the legal nature of the connections between the applicant and the other companies. In this case, at the request of the awarding body, it shall be demonstrated that the candidate will actually have the necessary resources at his disposal, for example by submitting a corresponding undertaking from that undertaking.

The undertakings on which an applicant relies to demonstrate his or her suitability shall meet the suitability in relation to those selection criteria for which the applicant relies on the suitability of the undertaking to demonstrate. In addition, at the request of the awarding authority for this company, a declaration on the existence of exclusion grounds according to §§ 123, 124 GWB must be submitted.

If an applicant makes full or partial use of the capacities of other companies in terms of professional capacity or relevant professional experience (especially references), this company must also provide the service for which the capacities are required.

1. Evidence, declarations and documents to be submitted with the application for participation:
   • self-declaration on the absence of grounds for exclusion according to § 123 GWB,
   • self-declaration on the absence of grounds for exclusion according to § 124 GWB,
   • self-declaration on Article 5k of Regulation (EU) 2022 /576,
   • self-declaration on the fulfilment of the commercial requirements and registration in the professional or commercial register. At the request of the awarding authority, the following documents must be submitted within a set time limit:
   • Certificates of safety of the tax office,
   • Certificate of safety of at least one social security institution and the professional association,
   • Certificates of conduct of all managing directors (if no managing director is appointed, all owners),
   • Business registration (if this is required by the company law of the state in which the company is located).
3. The awarding authority will obtain information from the competition register in preparation for the award decision.

1) Evidence, declarations and documents to be submitted with the application for participation:

• self-declaration on the total turnover as well as the turnover in the area of advertised (offered) services in the last three completed financial years,
• self-declaration that an operating, product and asset damage liability insurance for IT companies with a coverage of at least 1.5 million each. Euro for property and personal damage as well as for property damage
• in each case
• is available or such is concluded in the case of an order. (2) At the request of the awarding authority, the following documents must be submitted within a set deadline:
• the most recent confirmed annual report or
• the balance sheet as well as the P&L of the last three completed financial years,
• proof of a completed operational, product and asset damage liability insurance with the respective required coverage sums or the declaration(s) of an insurer to provide corresponding insurance protection in the required amount in the case of an order.

1) Evidence, declarations and documents to be submitted with the request to participate:

• self-declaration of the existence of at least 2 references for the introduction, migration or customization of a waste fee assessment software within the last 36 months before the submission of the request to participate,
• self-declaration of the existence of at least 2 references for the successful project management of a project of the intended project manager, which is comparable in terms of the number of employees employed, the system landscape and the duration, within the last 36 months before the submission of the request to participate,
• self-declaration of the existence of at least one reference (within the last 36 months before the submission of the request to participate) for the operation of the intended software product with at least the following functions:
• Container management
• Container orders (residual waste, organic waste) incl. Order status tracking
• Evaluation of telematics data
• Complaints including order status tracking
• Custom creation of reports
• Support of work-sharing processes via custom workflows
• Fee assessment for waste fees (annual fees, service fees) and billing of optional services (e.g. bulky waste fee)
• Online services (customer portal) The proof can be provided by the proof of a reference project which completely covers the functional scope or by the proof of several reference projects which cumulatively cover the above functional scope. At the request of the contracting authority, the references (at least with the indication of the contracting entity, the contractor, the contractual commitment, the content/size of the service, the service period/time of the project, the project status [ongoing, completed, successful active operation]) shall be provided.

1) Evidence, declarations and documents to be submitted with the request to participate: - self-declaration that the intended software product ensures proper and secure operation with regard to data organization, data structure and processing rules. At the request of the contracting authority, the confirmation of an auditor or a similar institution on the examination and release of the intended software product in relation to the applicable accounting rules must be submitted.
