Conclusion of framework agreements for the delivery of a turnkey PKI solution for the police NRW

With regard to the framework agreement, no minimum quantities are agreed. According to the case law of the ECJ of 17.06.2021 RS C - 23/20 - the customer is obliged to indicate a maximum quantity in order to ensure transparency and non-discrimination in competition. A call obligation cannot be derived from this. The client estimates that products and services in the amount of approximately 500,000 euros are called up from the framework agreement during the entire contract period. The maximum amount of the existing framework agreements is estimated at 600,000 euros. The framework agreement ends without the need for termination, whichever occurs earlier, with the expiry of the term of the framework agreement (minimum term in the event of exercise of the right of termination by the customer, or maximum term in the event of missing termination of the customer) or when the maximum amount is reached.
