Economic operators submitting tenders must prove a form of registration under the law of the country of residence, showing that they are legally constituted, that they are not in any of the situations of annulment of the constitution and that they have the professional capacity to carry out the activities covered by the public contract.

The requirement shall also apply to subcontractors, for the part of the contract they are to undertake, which will complement the information related to their situation at the level of a separate DUAE. Method of fulfilment: the DUAE will be completed by the economic operators participating in the award procedure with information related to their situation.

The supporting documents proving the fulfilment of the declared documents, i.e. the finding certificate issued by the ONRC or, in the case of foreign bidders, equivalent documents issued in the country of residence, are to be submitted, at the request of the contracting authority, only by the highest bidder in the intermediate ranking drawn up on completion of the tender evaluation process following the application of the award criterion.

The main and secondary activity (if any) and the relevant CAEN codes must be derived from the certificate. The information in the finding certificate shall be real / valid at the date of its submission.

The subject matter of the contract must have a corresponding number in the CAEN codes (main and / or secondary activities) entered in the certificate of establishment issued pursuant to Article 122 (7) and (9) of Law No 265 / 2022 on the register of trade and for amending and supplementing other normative acts having an impact on the registration in the register of trade. Foreign legal entities will present documents in translation authorized in Romanian.

The document will have to be presented by both the tenderer and the associate tenderer, if any. Where parts of the contract will be executed by subcontractors, proof of registration and correspondence of the principal / secondary activities within the contract with the subject-matter of the procurement will also be submitted by subcontractors for the part of the contract they will perform.

Information and / or minimum level (s) necessary to assess compliance with the said requirements shall demonstrate that, over the last 3 years, calculated from the closing date for the submission of tenders, they have also delivered similar products within a minimum of 1, maximum 3 supply contracts, in the aggregate amount of at least 50,000,00 lei without VAT. The last 3 years will be calculated by the closing date for the submission of the tender initially set out in the contract notice.

Where the contracting authority is required, for whatever reasons, to delay the deadline set for submission of tenders, the lower limit of the 3-year period shall be extended by the time period corresponding to the gap and the requirement for all operators who have submitted proof that the similar experience contract has been concluded within the new time period. Economic operators shall provide information on similar experience.

Similar products will be considered as those for identical or similar uses and are part of the normal range of products that are supplied / marketed by economic operators with constant activity in the sector (e.g. licences / IT applications).

Method of implementation: The DUAE shall be completed by economic operators participating in the award procedure with information describing their level of experience, by reference to contracts executed in the past, corresponding to the requirements of the contracting authority.

The supporting documents proving the fulfilment of the declared documents are to be submitted, at the request of the contracting authority, only by the highest bidder in the intermediate ranking drawn up on completion of the tender evaluation process, following the application of the award criterion.

The highest bidder in the intermediate ranking drawn up at the end of the tender evaluation process, following the application of the award criterion, shall present edifying documents / certificates (recommendations, minutes of receipt, finding documents, other equivalent), relating to each contract invoked as similar experience (minimum 1-maximum 3 contracts in the aggregate value of at least 50,000,00 lei without VAT), issued or countersigned by one authority or by the beneficiary private client, resulting in delivery over the last 3 years, calculated from the date-limit for the submission of the offer, of similar products.

The last 3 years will be calculated by the closing date for the submission of the tender initially set out in the contract notice. Where the contracting authority is required, for whatever reasons, to delay the deadline set for submission of tenders, the lower limit of the 3-year period shall be extended by the time period corresponding to the gap and the requirement for all operators who have submitted proof that the similar experience contract has been concluded within the new time period. Foreign legal persons will present the documents in the form of an authorised translation.
