Economic operators submitting tenders must prove a form of registration under the law of the country of residence, show that they are legally constituted, that they are not in any of the situations of annulment of the constitution and that they have the professional capacity to carry out the activities covered by the contract. Method of fulfilment: the DUAE will be completed by the economic operators participating in the award procedure with information related to their situation.

The supporting documents proving the fulfilment of those declared, namely the finding certificate issued by the ONRC or, in the case of foreign bidders, equivalent documents issued in the country of residence, are to be submitted, at the request of the contracting authority, only by the highest bidder in the intermediate ranking drawn up on completion of the evaluation of tenders. The main and secondary activity (if any) and the relevant CAEN codes must be derived from the certificate.

The information in the finding certificate shall be real / valid at the date of its submission. The subject matter of the contract must be corresponding in the CAEN codes (main and / or secondary activities) entered in the certificate and must be authorised in accordance with the provisions of Article 122 (7) and (9) of Law No 265 / 2022 on the register of trade and for amending and supplementing other normative acts affecting the registration in the register of trade.

Foreign legal entities will present documents in translation authorized in Romanian. The document will have to be presented by both the tenderer and the associate tenderer, if any.

The economic operator shall provide information on similar experience. Method of fulfilment: the DUAE shall be completed by the economic operators participating in the award procedure with the information describing their level of experience, by reference to contracts executed in the past, corresponding to the requirements of the contracting authority, during a period covering no more than the last 3 years calculated by the closing date for submission of the tender set out in the contract notice.

The Association (s), subcontractors and third-party nominees will present separately the DUAE containing the requested information. The tenderer will demonstrate that, within the last 36 months calculated from the closing date for the submission of the tender, he has made at least one delivery and a maximum of 3 (three) deliveries of similar products.

The same products will be considered as those for identical or similar uses and are part of the normal range of products that are supplied / marketed by economic operators with constant activity in the sector (e.g. licences).

In order to widen competition and facilitate the access of as many economic operators as possible to the procurement procedure, the contracting authority shall require proof of similar experience at a minimum level of 1 (one), a maximum of 3 (three) contracts for the supply of similar products, without imposing a certain threshold. The contracting authority shall focus on the competencies and performance of tenderers in delivering similar products and not on the financial dimension of previous contracts.

The Association (s), subcontractors and nominated third parties shall present separately the DUAE containing the requested information. The following documents shall be submitted with the DUAE:
