Economic operators submitting the offer must prove a form of registration under the conditions of the law of the country of residence, to reiterate that the economic operator is legally constituted, that it is not in any of the situations of cancellation of the constitution and that it has the professional capacity to perform the activities covered by the contract.
How to demonstrate compliance with the requirement: the D.U.A.E. will be completed by economic operators participating in the award procedure with information related to their situation. The supporting documents proving the fulfilment of those assumed by the completion of the D.U.A.E. shall be submitted, at the request of the contracting authority, only by the highest bidder in the intermediate ranking drawn up on completion of the evaluation of tenders. Documents requested:
- for Romanian legal entities: - certificate issued by the Trade Register Office;
- for foreign legal entities: - edifying documents proving a form of registration as legal person or of registration / attestation or professional membership, in accordance with the legal provisions of the country in which the tenderer is resident. The documents will be presented together with their authorised translation into Romanian. In the case of an association, each associate shall provide these documents.As the documents will be requested from the highest bidder, they will be valid at the time of submission. Failure to submit such documents shall lead to the exclusion of the tenderer from the proceedings.

Punctajul se acorda astfel: a) Pentru cel mai scazut dintre preturi se acorda punctajul maxim alocat; b) Pentru celelalte preturi ofertate punctajul P(n) se calculeaza proportional, astfel: P(n) = (Pret minim ofertat / Pret n) x punctaj maxim alocat.

Cerința minimă C21 enunțată în Anexa nr. 1 la Caietul de sarcini în raport cu care se acordă punctaj este următoarea: „Garanția pentru întreaga soluție GIS software livrată trebuie să fie de minimum 12 luni de la data recepției finale.” Algoritm de calcul: Punctajul pentru factorul de evaluare ,,Durata garanției produsului” se va acorda după cum urmează: PFact1oferta analizata = 20 x Fact1oferta analizata / Fact1maxim , unde: PFact1oferta analizata = punctajul acordat ofertei analizate pentru factorul ,,Durata garanției produsului” Fact1oferta analizata = durata garanției produsului din oferta analizată; Fact1maxim – cea mai mare durată a garanției produsului dintre ofertele analizate; Durata garanției va fi exprimată în luni și va fi precizată în mod explicit în propunerea tehnică. NOTĂ: Ofertele care nu respectă cerința C21 enunțată în Anexa nr. 1 la Caietul de sarcini, vor fi declarate neconforme. Punctajul total pentru oferta analizată se acordă astfel: Punctaj ofertă analizată = Ppreț ofertă analizată + PFact1oferta analizata Punctajul maxim total care poate fi obținut de către un ofertant: 100 puncte Punctajele factorilor de evaluare se stabilesc cu maxim 2 zecimale. Dacă a treia zecimală este egală sau peste 5, rotunjirea se face în sens pozitiv, iar dacă a treia zecimală este sub 5 atunci rotunjirea se face în sens negativ.
