Requirement 1 The tenderer (each participating economic operator) must prove a form of registration in accordance with the legal requirements of the country in which it is established (be registered in a professional or trade register in the country in which it is established) showing that the economic operator is legally established, is not in any situation of cancellation of its establishment, and has the right (legal capacity) to lawfully perform/carry out on the market the activities that are the subject of the contract.

Requirement 2 The tenderer (economic operators) must not be in any of the situations subject to the sanctions provided for by Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine, as subsequently amended and supplemented.

As preliminary evidence for verifying the capacity to exercise professional activity, economic operators must submit: (i) the ESPD, completed via SEAP; (ii) a self-declaration regarding compliance with the provisions stipulated by Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine, as subsequently amended and supplemented (the form made available by the contracting authority in Section D – "Forms" of the procurement documents - Form no. 8 shall be used).

Each participating economic operator shall submit a separate ESPD, as specified above. Following an express request from the contracting authority and prior to the signing of the contract, the tenderer ranked first after applying the award criterion must submit updated supporting documents requested by the contracting authority demonstrating the fulfillment of the qualification criteria, in accordance with the information contained in the ESPD.

Pursuant to Article 173(1) of Law no. 98/2016, as amended and supplemented: "The contracting authority has the right to request any economic operator to submit relevant documents proving the form of registration and, where appropriate, professional attestation or membership, in accordance with the legal requirements of the country in which the economic operator is established." The updated supporting documents must: i. Support the declarations/information included in the ESPD under the requested section(s); ii.

Demonstrate that: a. The economic operator is legally established in its country of origin and is not in any situation of cancellation of its establishment;

b. It lawfully carries out its professional activity on the market: i. there is a correspondence between the main subject matter of the contract and the economic activity indicated in the Articles of Association/incorporation document of the economic operator under the NACE code (Statistical Classification of Economic Activities in the European Community) or equivalent, for the economic operator/economic operators acting as tenderer. ii. there is a correspondence between the activity associated with the role of the economic operator in the procedure and the economic activity mentioned in the articles of association/incorporation document of the economic operator under the NACE code (Statistical Classification of Economic Activities in the European Community) or equivalent, for economic operators related to the tenderers, if applicable.

Supporting documents deemed appropriate for demonstrating the information included in the ESPD that economic operators submit to the contracting authority include, but are not limited to: i. certificates issued by the professional register or trade register, or equivalent documents issued by the competent authorities of the country in which the economic operator is established; ii. other evidence that the economic operator may submit in accordance with the legislation of the country in which it is established.
