Annex A6 - To demonstrate eligibility to exercise the profession, I/we, as bidder or consortium of bidders / subcontractor / entity relied upon for capacity, declare:

1. that no person whose conduct is attributable to our company pursuant to Section 123 (3) GWB, nor we as a company, have been convicted with final and binding legal effect for any of the criminal offenses listed in Section 123 (1) GWB or equated thereto pursuant to Section 123 (2) GWB, nor has a fine been legally bindingly imposed on us as a company pursuant to Section 30 of the Act on Regulatory Offences (OWiG);
2. that we as a company have regularly fulfilled our obligations for the proper and timely payment of taxes, duties, or social security contributions in accordance with the statutory provisions of the country in which we are established, and that no final and binding court decision or legally enforceable administrative decision exists in this regard, or that we have met our obligations by undertaking to pay taxes, duties, and social security contributions including interest, late payment penalties, and fines, and will properly comply in the future, and that no arrears are due at the time of submitting this self-declaration;
3. that we as a company have not breached applicable environmental, social, or labor law obligations in the performance of public contracts;
4. that we as a company are not insolvent, that no insolvency proceedings or comparable proceedings have been applied for or opened regarding the assets of the company, that the opening of such proceedings has not been rejected for lack of assets, and that the company is not in liquidation or has ceased its activities; (If insolvency proceedings or comparable statutory proceedings regarding the assets of the company have been opened, or if the opening of such proceedings has been applied for, or if such application was rejected for lack of assets, I/we declare that I/we have additionally attached current evidence proving my/our economic and financial standing.)
5. that we as a company, or a person whose conduct is attributable to the company, have not committed any grave misconduct in the course of professional activity that calls the integrity of the company into question;
6. that we as a company have not entered into any agreements with other economic operators aimed at or resulting in the prevention, restriction, or distortion of competition;
7. that no circumstances exist that could give rise to a conflict of interest in the conduct of the procurement procedure which could compromise the impartiality and independence of the contracting authority or persons acting on behalf of the contracting authority;
8. that, despite any prior involvement of our company in the preparation of the procurement procedure, no distortion of competition has occurred;
9. that we as a company have always properly and timely fulfilled the essential requirements of public contracts in the execution of a prior public contract;
10. that I/we have not made any inaccurate statements in this procurement procedure, including with regard to exclusion grounds and selection criteria, and am/are in a position to submit the required evidence upon request;
11. that I/we as a company - have not attempted to unduly influence the decision-making process of the contracting authority, - have not attempted to obtain confidential information that could confer undue advantages in the procurement procedure, - have not negligently or intentionally submitted misleading information that could significantly influence the award decision of the contracting authority or attempted to submit such information;
12. that we as a company particularly fulfill our obligations to pay the minimum wage under the Minimum Wage Act (MiLoG) and to guarantee working conditions under the Posted Workers Act (AEntG), and do not violate or have not violated the Act to Combat Clandestine Employment (SchwarzArbG), and that the conditions of Section 19 MiLoG, Section 2…

Appendix A7 - To prove his/her financial and economic performance, the bidder or the bidding community/qualification provider declares: I/We hereby declare(s) that I/we or my/our company have a professional liability insurance or, in the event of the award of the contract, will conclude it immediately. The insurance must have at least the following coverage sums per damage event: - from EUR 3.000.000.00 lump sum for personal and property damage, - from EUR 1.000.000.00 for property damage.

The coverage amounts are available twice maximized per insurance year. In the case of an applicant/tenderer community or in the case of the suitability loan, I/We guarantee that the existing or to be concluded professional/company liability insurance also covers the specific contractual relationship in the case of a surcharge. I/We undertake, at the separate request of the awarding authority, to provide proof of this by submitting a copy of the insurance document.

Appendix A8 - In order to prove his/her technical and professional capacity, the tenderer or the group of tenderers/subcontractors/qualifiers (Appendix A8 of the procurement documents): a declares that (i). I/we are either the manufacturer itself or (ii) have the necessary authorization or certification of the manufacturer in order to be able to perform the advertised services on the offered ETERNUS CS8800 or (iii).

I/we use the manufacturer in case of surcharge to perform the advertised services on the offered ETERNUS CS8800. b) that I/we are the manufacturer or that there is a privileged cooperation between me/us and the manufacturers (possibly also distributors) of the systems to be offered (e.g. premium partner, gold partner).

Appendix A9 - In addition, the tenderer or to provide the tendering association/qualification provider with additional proof of his/her technical and professional capacity, a reference list containing the reference contracts which have been concluded within the last three years (i.e. ongoing contractual relationships or contractual relationships which have been terminated within the last three years) and which are as similar as possible to the content and requirements of the tendered services.

In particular, the reference list must contain the following minimum information: reference order "installation and configuration of a CentricStor" - at least one reference order in which the complete installation and configuration of an ETERNUS CS8800 system has been carried out by the bidder itself or by the manufacturer Fujitsu. - Description of this reference order with information on the system environment (hardware and software, if applicable special features) and the performance scope (keyword-like presentation of the work carried out).

Reference order "Configuration of a georedundant data replication from a CentricStor" - at least one reference order in which a long distance replication (cascading) of data from an ETERNUS CS8800 to an ETERNUS CentricStor to a georedundant location has been configured by the bidder itself or by the manufacturer Fujitsu. - Description of this reference order with information on the system environment (hardware and software, if applicable special features) and the scope of services (keyword-like presentation of the work and procedures carried out). In addition, the reference list for each reference contract must contain the following minimum information:

• Reference name (name and registered office of the reference company),
• Field of activity of the reference company,
• Contact person at the reference company
• Contact person at the reference company (e-mail address and/or telephone number),
• Indication of who submits the reference: "Tender", "Tender community", "Supplier of suitability (subcontractor)",
• Indication of whether the reference customer is a direct contractor of the reference company or is used as a subcontractor,
• Brief description of the reference and presentation of the comparability of the reference with the procurement project.
• Duration of the reference order (dd/mm/yyyy -dd/mm/yyyy). Notes: New contractual relationships whose term has not yet begun are not permitted as reference proof. Offers with an incomplete reference list (in particular missing minimum information, such as missing contact details) can be excluded from the further procedure.It is not sufficient if the contact person of the reference customer is specifically named to the contribution service only on request, since the contribution service intends to check the specified reference. In case of doubt, the applicant must first ask the reference customer’s contact person for his consent in order to resolve data protection concerns.If the minimum requirements are not met, the tender shall be excluded from the further procedure. The General Data Protection Regulation and the data protection laws do not prohibit the naming of a reference customer, if and insofar as he agrees with the reference information (consent to the data transfer).
