What the buyer wants
The tenderer must have the necessary human and technical resources and sufficient experience to perform the contract in an appropriate quality.
Attention, important note: The following selection criteria (submission of references) apply across the board, i.e.: A reference is sufficient both for the case that a tender is for only one lot and for both lots. 5.4.2.2.1 Minimum technical and professional capacity requirements The following minimum criteria have been established for the technical and professional capacity of a tenderer: 5.4.2.2.1.1 References: [Evaluation of the APPENDIX Reference Description] At least one comparable reference project which has been successfully completed in the last three years (calculated from or until the offer deadline) shall be provided.
For this purpose, the APPENDIX reference description must be completed in full (possibly several times for naming several reference projects) with the offer. A reference project is then comparable to the object of the contract if it essentially corresponds to the framework conditions resulting from the specification of services (part B of the award documents) (type of service, duration of the contract, technical environment, etc.).
In particular, the comparability takes into account the extent to which the following comparability criteria are met (cumulatively): The reference must be close to or substantially similar to the advertised service.
Complexity: The technical claim of the comparison object must correspond approximately to the target object. - Organisational environment: contracting authorities A reference project is considered to have been successfully completed if it was started after the abovementioned deadline and has been running for at least 6 months The assessment shall take place in an overall assessment of the submitted references. It is not mandatory to submit several references in order to prove the necessary suitability.
This can also be achieved with a single reference which exceptionally reflects the subject-matter of the contract. However, the contracting authority allows the tenderer to submit several references in order to facilitate the coverage of the contract.
With reference to the decision of the Dusseldorf Higher Regional Court (decision of 12.09.2012 – Verg 108/11), in which the awarding Senate considered a specification of services, which limited the references to three, to be contrary to procurement law, the awarding authority points out the following: The awarding authority does not impose any restriction on the references to be submitted.
However, the awarding authority assumes that, in principle, consideration of a comparable reference is sufficient for a positive assessment of the capacity. However, this is not a mandatory requirement, so that the bidder does not suffer any disadvantages in the case of a submission of more than one reference.
The suggestion to submit a comparable reference, if possible, is based on the idea that the awarding authority assumes that it is not necessary to submit a higher number of references in order to be able to assess the experience with regard to the subject matter of the procurement. In addition, the evaluation of a very high number of reference descriptions can require a disproportionately long processing time.
If the evaluation of the reference description in accordance with the APPENDIX Reference Description does not make it possible to forecast that the tenderer will perform the contract in a technically sound and timely manner, the performance will be denied and the offer will be excluded from the further evaluation. Only what is explicitly described in the APPENDIX Reference Description Form can be taken into account in the assessment.
The contracting entity and the contracting authority will, where appropriate, check references at random or on the basis of suspicion. For this purpose, the bidder on Anf
