C. Conditions for participation 1.1) Suitability and authorization to pursue a professional activity 1.1.1) Commercial register extract or alternative proof: The applicant must submit proof of registration in the commercial register of the country in which the applicant is established. The extract from the commercial register must not be older than six months at the time the deadline for participation expires.

Alternatively, the applicant may state the electronic address where the extract can be accessed free of charge, without restriction, completely, and directly. If the applicant, a member of a consortium/bidding consortium, or a third party (in the case of reliance on the capacities of other entities) is not listed in the commercial register, proof of the authorized pursuit of the professional activity by other means shall suffice.

For Member States of the European Union, the respective professional or commercial registers and certificates or declarations concerning the pursuit of the professional activity are listed in Annex XI of Directive 2014/24/EU of the European Parliament and of the Council of 26 February 2014 on public procurement and repealing Directive 2014/18/EC, OJ L 94 of 28 March 2014, p. 65. 1.2) Economic and financial standing List and brief description of selection criteria: 1.2.1) Declaration of financial and economic standing (according to form "Data_02.04_Anlage_4_Wirtschaftliche technische Leistungsfähigkeit") (a) Liability insurance: Proof of commercial liability insurance covering liability risks arising from the applicant's business activities for property damage, personal injury, and financial loss (including financial loss for data protection reasons) must be provided by submitting a valid insurance certificate.

The insurance contract must cover the aforementioned risks and provide the minimum coverage amounts specified below. This proof must be provided upon request by the contracting authority – otherwise at the latest by the start of the contract. In the case of an application by a consortium, the consortium as a whole is decisive with respect to the proof and fulfillment of the requirements for commercial liability insurance.

However, if a member of the consortium submits proof of insurance, it must be clear from the proof of insurance that claims against the consortium resulting from damage caused by other members of the consortium are also covered by the insurance policy. This proof must be provided upon request by the contracting authority – otherwise at the latest by the start of the contract.

Alternatively to the minimum requirements set out below, the economic operator interested in the contract may declare that, in the event of an award, it will take out insurance that meets the specified requirements.

In this case, the applicant must undertake to take out corresponding commercial liability insurance meeting the stated requirements immediately upon receipt of the award, to maintain it for the duration of the contract term, and to provide the relevant certificate to the contracting authority immediately and without being requested to do so.

The economic operator may also voluntarily submit, together with the request to participate, a declaration from the insurer confirming that the insurer is prepared to conclude corresponding insurance in the event of an award (according to form "Data_02.04_Anlage_4_Wirtschaftliche technische Leistungsfähigkeit"). 1.2.2) Credit report: A credit report (e.g. from CreditSafe, D&B, Crif Bürgel, or Creditreform) stating the rating, which must not be older than six months at the time the deadline for participation expires, must be submitted.
