As far as the contractor’s experience is concerned, the condition will be met if the contractor demonstrates that it has experience in the form of a proper performance within the last 3 years before the deadline for the submission of tenders, and if the period of business is shorter, during that period at least one contract covering the supply of at least one firewall with a contract value of not less than PLN 25500,00 gross. Contractors jointly applying for a contract shall fulfil the conditions for participation in the procedure concerning technical or professional capacity in the area of the contractor's experience together. When assessing technical or professional capacity, The contracting authority may, at any stage of the procedure, consider that the contractor does not have the required capacity if the contractor has conflicting interests, in particular the involvement of technical or professional resources of the contractor in other economic activities of the contractor may adversely affect the performance of the contract. To confirm compliance with the technical or professional capacity condition, The Contracting Authority shall require that, in accordance with the model set out in Annex 6 to the SWZ, a list of deliveries made and, in the case of recurring or continuous benefits, also carried out, over the last 3 years and if the period of business is shorter, within that period, with the indication of their value, subject matter, dates of performance and entities for which supplies have been made or are carried out, and the addition of evidence indicating whether those supplies have been made or are carried out duly, with the evidence referred to therein being references or other documents drawn up by the entity for which the supplies have been made, and in the case of repeated or continuous benefits, and if the contractor is unable to obtain such documents for reasons independent of him or her, a statement by the contractor; in the case of the benefits repeated or continuing to be performed, references or other documents supporting their performance should be issued within the last 3 months. Where the contractor cites experience in the implementation of the supplies carried out jointly with other economic operators, the list of deliveries referred to above shall relate to the supplies in which the contractor directly participated. The contractor may rely on the technical or professional capacity of the entities making the resources available, irrespective of the legal nature of the legal relationship between him and him, in order to confirm that the conditions laid down in Article 118 of the UPP are met. The economic operator, which relies on the capacity of the entities making the resources available, shall, together with the offer, require the entity making the resources available to it to carry out the necessary resources for the performance of the contract (made in accordance with the model set out in Annex 5 to the SGM) or any other body-based evidence proving that the contractor will have the necessary resources for the performance of the contract. The list of personal evidence requested by the Contracting Authority to confirm the condition of participation in the procedure is contained in the procurement documents available on the website of the tender procedure. The Contractor may, instead of the relevant body of evidence, submit a certificate confirming the certification of public procurement contractors in the scope referred to in Article 3(2)(1) or (2) of the Certification Act respectively.
