O udzielenie zamówienia mogą ubiegać się Wykonawcy, którzy nie podlegają wykluczeniu na podstawie art. 108 ust. 1 ustawy Pzp oraz spełniają warunki udziału w postępowaniu dotyczące: 1.1 Zdolności do występowania w obrocie gospodarczym. Zamawiający nie wyznacza szczegółowego warunku w tym zakresie. 1.2 Posiadania uprawnień do prowadzenia określonej działalności gospodarczej lub zawodowej, o ile wynika to z odrębnych przepisów.Zamawiający nie wyznacza szczegółowego warunku w tym zakresie. 1.3 Sytuacji ekonomicznej i finansowej. Zamawiający nie wyznacza szczegółowego warunku w tym zakresie. 1.4 Zdolności technicznej lub zawodowej.
    1. Dysponowanie osobami Zamawiający nie wyznacza szczegółowego warunku w tym zakresie.
    2. Wiedza i doświadczenie Zamawiający nie wyznacza szczegółowego warunku w tym zakresie.
  2. O udzielenie zamówienia mogą ubiegać się Wykonawcy, którzy nie podlegają wykluczeniu z udziału w postępowaniu na podstawie art. 108 ust. 1 ustawy Pzp.
  3. Zamawiający przewiduje wykluczenie na podstawie art. 109 ust. 1 pkt 8 i 10 ustawy Pzp.
  4. Zamawiający przewiduje wykluczenie na postawie art. 7 ust. 1 ustawy z dnia 13 kwietnia 2022 r. o szczególnych rozwiązaniach w zakresie przeciwdziałania wspieraniu agresji na Ukrainę oraz służących ochronie bezpieczeństwa narodowego z postępowania o udzielenie zamówienia publicznego prowadzonego na podstawie ustawy Pzp wyklucza się:
  1. Wykonawcę wymienionego w wykazach określonych w rozporządzeniu 765/2006 i rozporządzeniu 269/2014 albo wpisanego na listę na podstawie decyzji w sprawie wpisu na listę rozstrzygającej o zastosowaniu środka, tj. wykluczeniu z postępowania;
  2. Wykonawcę, którego beneficjentem rzeczywistym w rozumieniu ustawy z dnia 1 marca 2018 r. o przeciwdziałaniu praniu pieniędzy oraz finansowaniu terroryzmu (Dz. U. z 2025 r. poz. 644 z późn. zm.) jest osoba wymieniona w wykazach określonych w rozporządzeniu 765/2006 i rozporządzeniu 269/2014 albo wpisana na listę lub będąca takim beneficjentem rzeczywistym od dnia 24 lutego 2022 r., o ile została wpisana na listę na podstawie decyzji w sprawie wpisu na listę rozstrzygającej o zastosowaniu środka, tj. wykluczeniu z postępowania.
  3. Wykonawcę, którego jednostką dominującą w rozumieniu art. 3 ust. 1 pkt 37 ustawy z dnia 29 września 1994 r. o rachunkowości (Dz. U. z 2026 r. poz. 522 z późn. zmianami) jest podmiot wymieniony w wykazach określonych w rozporządzeniu 765/2006 i rozporządzeniu 269/2014 albo wpisany na listę lub będący taką jednostką dominującą od dnia 24 lutego 2022 r., o ile został wpisany na listę na podstawie decyzji w sprawie wpisu na listę rozstrzygającej o zastosowaniu środka, tj. wykluczeniu z postępowania.
  4. Zamawiający wymaga, aby oferowane świadczenie, w tym wszystkie produkty ICT, usługi ICT oraz procesy ICT wykorzystywane do realizacji zamówienia, zarówno jako elementy główne, jak i komponenty, elementy środowiska świadczenia usługi lub rozwiązania towarzyszące, nie obejmowało:
  1. produktów ICT, usług ICT lub procesów ICT wskazanych w rekomendacji, o której mowa w art. 33 ust. 4 ustawy z dnia 5 lipca 2018 r. o krajowym systemie cyberbezpieczeństwa, stwierdzającej ich negatywny wpływ na podstawowy interes bezpieczeństwa państwa;
  2. produktu ICT, którego typ został określony w decyzji w sprawie uznania dostawcy za dostawcę wysokiego ryzyka, o której mowa w art. 67b ust. 15 ustawy z dnia 5 lipca 2018 r. o krajowym systemie cyberbezpieczeństwa, ani usług ICT lub procesów ICT określonych w tej decyzji. Niespełnienie powyższego wymagania skutkuje odrzuceniem oferty odpowiednio na podstawie art. 226 ust. 1 pkt 17 albo pkt 19 ustawy Pzp.
  3. O udzielenie zamówienia nie mogą ubiegać się wykonawcy, którzy prowadzą działalność gospodarczą oraz mają siedzibę albo miejsce zamieszkania w innych państwach niż państwa członkowskie Unii Europejskiej oraz innych niż państwa będące stronami Porozumienia Światowej Organizacji Handlu w sprawie zamówień rządowych lub stronami innych umów międzynarodowych gwarantujących n
