Delivery of network switches, licences and training vouchers for the Kraków appeal courts

1. The subject of the order is the supply of network switches for the needs of the courts of the Kraków appeal together with the delivery of licences for network switches of the management and monitoring system and training vouchers. 2. The detailed description of the subject-matter of the contract is contained in Annex No 2 to the SWZ – Description of the subject-matter of the contract (OPP) together with Annexes No 2.1 to the SWZ-Technical parameters, and the conditions for performance of the contract are contained in the Model of the contract constituting Annex No 8 to the SWZ. This description should be read together with any changes in the content of the WWZ, e.g. the result of the responses to the Contractors' inquiries. 3. All equipment supplied as part of this order must be covered by a guarantee valid for a minimum period of 36 months. 4. The parameters given in the Order Description are minimum values and each Equipment with better/higher parameters than specified meets the requirements specified by the Ordering Party. 5. The Contracting Authority does not allow the syntax of partial offers. Reason for not dividing the contract into parts: The Contracting Authority has departed from the division of the contract into parts because the range covered by the contract is easily possible entirely by a large proportion of small and medium-sized entrepreneurs present on the market. Any split of the contract into parts would not increase the availability of the contract and therefore would not improve the competitiveness of the procedure, in particular would not ensure that more offers and lower prices of the supply offered are obtained. This division would therefore not be economically justified and its failure cannot constitute a breach of the principles of fair competition in the proceedings. Given the above, and that the possible division of the contract into parts would endanger technical difficulties and the need to coordinate the activities of the various economic operators implementing the various parts of the contract, which could impede the proper performance of the contract, this division in the evaluation of the contracting authority is unreasonable. The contract is addressed to Contractors from the SME sector. Therefore, the absence of a division does not prejudice the principles set out in Article 16(1) of the Public Procurement Act, i.e. the principles of competitiveness and equality
