Development and Installation of Digital Infrastructures for the Operation of the Employment Card System in the Public Sector

Economic operators involved in the procedure for concluding this shall be required to carry out a professional activity related to the subject-matter of the Convention. Economic operators established in a Member State of the European Union are required to be registered in one of the professional or commercial registers kept in their State of establishment or to satisfy any other requirement set out in Annex XI to Appendix I to Law 4412/2016.

Where economic operators are required to have a specific authorisation or to be members of a particular organisation in order to be able to provide the relevant service in their home country, the contracting authority may ask them to demonstrate that they have such authorisation or that they are members of that organisation or invite them to make a sworn declaration before a notary regarding the exercise of that profession.

In the case of economic operators established in a Member State of the European Economic Area (EEA) or in third countries which have joined the GPA, or in third countries which do not fall under the previous indent and have concluded bilateral or multilateral agreements with the Union on procurement procedures, they are required to be registered in their respective professional registers.

Economic operators established in Greece must be registered in the relevant professional register, provided that, under the legislation in force, they are required to register for the service to be awarded. In the case of an association of economic operators, the suitability for professional activity shall be required to be covered by at least one member of the association. (paragraph 2.2.4 of the Declaration).

With regard to technical and professional capacity for this procurement procedure, economic operators shall be required, subject to an exclusion penalty:

1. Have a credit institution recognised for the credit rating of the undertaking with a date of issue within the last 30 calendar days prior to the closing date for the submission of tenders, in accordance with Model V, Annex VIII, which will relate to working capital financing. The Candidate Contractor should have at least 100 % of the project budget without VAT.
2. Show profitability for the last three (3) management uses (2023, 2024, 2025) or during their period of operation if this is less than three (3) years.
3. Have an average general annual turnover for the last three (3) financial years (2023, 2024 and 2025) or, where the economic operator is active for a period of less than three years, for the financial uses in which it operates, at least equal to 100% of the estimated value of the project to be awarded without VAT. In the case of an association of economic operators, the above requirements shall be cumulatively covered by the members of the association. (paragraph 2.2.5 of the Declaration).

Economic operators involved in the process of conclusion of the present are required to have the appropriate documented and proven professional capacity in the implementation of projects of a similar size and complexity with the project to be awarded. In particular, it is required that during the last five (5) years from the closing date for the submission of tenders of this declaration, they have successfully completed in public, wider public and/or private sector entities, development projects of a system of corresponding complexity and characteristics in the scope of this declaration, cumulatively, as defined below:

1. At least one (1) project of a total contractual value equal to or greater than 10% of the estimated value of the project under assignment, which included the development and operation of an integrated communication, bridge and interoperability mechanism for the transmission of hourly class data on the turnout and departure from work for at least fifty thousand (50,000) workers and 1,000) operators or employers. Experience should be gained from the above project:
   • Illustration of events of attendance and departure from work through electronic means.
   • Interface with external information systems through Internet services (APIs, Web Services or corresponding technologies).
   • Management and processing of large data with increased safety requirements.
2. At least one (1) project of a corresponding object, which included:
   • the supply and installation of at least two thousand (2,000) portable multifunctional terminals,
   • the installation, configuration and installation of preinstalled software on devices,
   • the configuration of devices to communicate with a central information system.
   • The project should be implemented at locations with geographical spread. ‘Geographical dispersal’ means the development, installation and entry into service of terminal devices in multiple, spatially distinct installations of the same or different operators, which are not limited to a single geographical area, demonstrating the economic operator’s ability to organise, coordinate and implement major operational complexity projects with distributed implementation points.The latter requirement is directly related to the subject-matter of the contract and is proportionate to it, since the project under award includes the development and operational activation of a large number of terminal devices to public bodies established throughout the Greek territory.The requirement is to identify the ability of economic operators to manage the organisational, technical and operational complexity of a nationwide project, including the coordination of multiple field workshops, the compliance of uniform installation and parameterisation procedures and the timely implementation of a large number of geographically dispersed points.
3. At least one (1) IT project involving the provision of a unified cybersecurity platform Next Generation SOC and its installation in the government computing cloud. In the case of an association of economic operators, the requirements of technical competence reference projects may be cumulatively covered by the members of the association (paragraph 2.2.6 of the Declaration) Economic operators involved in the process of conclusion of the present are required to have a team of projects with executives sufficient in number and skills to undertake the project, in accordance with paragraph 2.2.6 of the Declaration.

The developing information system shall process personal data, including biometric data belonging to the specific categories referred to in Article 9 of Regulation (EU) 2016/679.

The design and implementation of technical and organisational security measures should take into account Regulation (EU) 2016/679 and Law 4624/2019 (I 137), the decisions and guidelines of the Personal Data Protection Authority and the European Data Protection Board, as well as recognised best practices and international standards of information systems security, in particular ISO/IEC 27001.

In this context, economic operators for this procurement procedure must have a certificate relating to the quality of the services provided by the tenderer (quality assurance certificate of the services provided or official certifications by competent offices or services to comply with specifications or standards) in force, namely a certificate from an independent accredited body for the management of the quality of services in the following areas:

• ISO 9001:2015 or equivalent standard certificate for their services in the field of design, implementation and operation of IT infrastructures;
• ISO 14001:2015 certificate or equivalent standard for their services in the field of design, implementation and operation of IT infrastructures;
• ISO certificate 22301:2019 or equivalent standard, for IT &mp technology services; Cloud services,
• ISO 27001:2022 or equivalent standard certificate on data security, data hosting at Data Center
• ISO certificate 27701:2019 or equivalent standard for personal data processing services provided The contracting authority shall recognise equivalent certificates issued by bodies accredited by equivalent accreditation bodies established in other Member States.It shall also accept other evidence of equivalent quality assurance measures, provided that the economic operator concerned has not been able to obtain those certificates within the relevant time limits for reasons for which he is not responsible, provided that the economic operator demonstrates that the proposed quality assurance measures meet the required quality assurance standards.Those certificates should have been issued by an entity accredited by the ESYD or by an internationally accredited body at least (30) thirty days before the final date of submission of the tender. In the case of an association of economic operators, the above requirements shall be cumulatively covered by the members of the association. (paragraph 2.2.7 of the Declaration).
