What the buyer wants

The subject of procurement is the temporary licensing and use of a web-based, responsive (self-) coaching and learning platform. The Progressive Web App (PWA) is intended to provide managers with structured, self-responsible self-coaching on the five leadership perspectives of the FLB and to offer collegial learning and reflection formats. For this purpose, a framework contract with a duration of 4 years is to be concluded. The maximum value is 150% of the contract value to be charged.

For this purpose, the ANNEX Reference Description must be submitted fully completed with the tender (multiple times for naming several reference projects). Substantially comparable = A reference project is comparable to the subject matter of the contract if it substantially corresponds to the framework conditions resulting from the specification of services (Part B of the procurement documents) (type of service, contract duration, technical environment, etc.). In the present case, this means in particular if the reference service per reference project consists of the provision of licenses for at least 200 users of a web app for a (self-)coaching and learning offer for executives with content comparable to the tendered service within the last three years (calculated up to the tender deadline). Successfully performed = means in this context that the execution of the contract has (so far) proceeded according to plan and has not been terminated prematurely. In this respect, it is not strictly necessary for the contractual relationship to have already ended. Reference contracts that are currently still ongoing can also be evaluated. In that case, however, licenses for at least 200 users must have already been provided. If a check of the reference with the reference contact person reveals that the services had significant defects and were to a not insignificant extent not performed in conformity with the contract, the reference shall be deemed not 'successfully completed' with the consequences as described below under 'Verification / Reference contact person'. With reference to the decision of the Higher Regional Court (OLG) of Düsseldorf (decision of 12 September 2012 – Verg 108/11), in which the Procurement Senate deemed a specification that limited the number of references to three to be contrary to public procurement law, the contracting authority points out the following: The contracting authority does not set any limit on the references to be submitted. However, the contracting authority assumes that an examination of 2 comparable references is generally sufficient for a positive determination of suitability. However, this is not a mandatory requirement, so that the tenderer will not suffer any disadvantages if more than 2 references are submitted. The indication to submit a maximum of 2 comparable references is due to the consideration that the contracting authority assumes it is not necessary to submit a higher number of references in order to evaluate experience regarding the procurement subject. In addition, evaluating a very high number of reference descriptions can take a disproportionately long processing time. If the evaluation of the reference description in accordance with the ANNEX Reference Description does not allow the prediction that the tenderer will execute the contract in a professionally flawless manner and on time, suitability will be denied and the tender excluded from further evaluation. In doing so, only what has been explicitly described in the ANNEX Reference Description form can be considered in the evaluation. The client and the contracting authority may check references on a random basis or if there is reason for suspicion.
