What the buyer wants
The municipality of Trebgast – hereinafter referred to as “Regionskorschaft” – leads to the selection of a network operator who can carry out the planning, construction and operation of an ultra-fast NGA network with a public subsidy according to §12 KonzVgV i.V.m. §14 para. 2, par. 3 VgV a negotiated procedure with an upstream competition. In the competition, the suitability (specialist knowledge, performance and reliability) of the applicants is examined at a first stage. All participants thus admitted shall be invited to submit tenders in a second stage and shall have the opportunity to submit an initial tender by the deadline for the submission of tenders. On the basis of this offer, the customer has the opportunity to conduct negotiations with the tenderers and, if necessary, invite them to submit an improved offer. The customer reserves the right to award the contract without negotiation after evaluation of the initial offers (cf. § 17 para 11 VgV). The contracting authority/entity shall select the most economical tender for the contract on the basis of the evaluation criteria documented in the procurement documents.
