Expansion and support of DWDM

The subject of the public contract is the obligation of the supplier to supply and subsequently implement technical and programming means for the expansion of existing DWDM facilities and to provide support services to them and to existing technical and programme resources. A closer specification of the subject-matter of the contract is given in the draft contract, which is annexed to No 1 of the procurement documents.

In view of the fact that the contracting authority has fully integrated existing HW and SW DWDM resources in its IS structure and the expansion of transmission capacity between sites by 100 Gb, it is not possible to carry out, for reasons of compatibility other than the use of the resources covered by this contract, and the transition to other HW and SW resources would entail disproportionate costs on the part of the contracting authority, whether the acquisition of a completely new DWDM equipment (also meant as existing means for which the replacement is not needed) or the necessary modification of all existing applications and systems used by the contracting authority, the contracting authority considers that in this case the subject of a public contract is justified by reference to a particular product, or to HW and SW means and to a specific producer whose acquisition is the object of that public contract.

The contracting authority has not accepted the division of the contract into parts, since the subject matter of the contract is one functional unit and is awarded in time. In the award of a public contract as a provider of a regulated service, the contracting authority is under a regime of higher obligations within the meaning of Act No 264 / 2025 Coll., on cyber security, as amended, and its implementing provisions, when this is taken into account by the contracting authority in the terms of the contract.
