The tenderers submitting the tender must prove a form of registration under the law of the country of residence, showing that the economic operator is legally constituted, that he is not in any of the situations of annulment of the constitution and that he has the professional ability to perform the activities covered by the public contract.

The subject matter of the contract must have a corresponding in the CAEN code of the established certificate issued by the O.N.R.C. or by the authorized institutions (in the case of foreign bidders). The tenderer is required to complete the DUAE with the information necessary to demonstrate the ability to pursue the professional activity.

The highest bidder at the end of the evaluation of tenders, at the request of the contracting authority, shall demonstrate the ability to carry out the professional activity (registration form and subject matter), by submitting the certificate to the N.R.C. or to foreign bidders, equivalent document issued in the country of residence, in the language in which it was issued, accompanied by the certified translation into Romanian.

All required documents will be submitted with extended electronic signature, based on a qualified certificate, issued by a certification service provider accredited under the law. The information in the U.N.R.C. certificate shall be real / actual at the date of its submission. UNCOMPLEMENTATION OF THE DUAE with the tender draws its rejection as unacceptable

Tenderers must prove that they have delivered within the last 3 years calculated in relation to the deadline for the submission of tenders (in the event of a postponement of the deadline for the submission of tenders, the lower limit of the period shall be extended by the time period corresponding to the postponement, the requirement being deemed fulfilled for all operators that provided proof of completion of the similar experience contract within the newly resulted timeframe), covering one or a maximum of three similar supply contracts with a cumulative value of at least EUR 307,000, excluding VAT (the value of the largest subsequent contract).

Similar products shall be understood as the supply of software products / software licenses. By the deadline set for the submission of tenders, participating economic operators shall duly complete the ESPD (European Single Procurement Document), pursuant to Art. 193 para. (1) of Law 98/2016, for each participating entity individually (as applicable: tenderer, associated tenderer, third-party supporter), in order to provide preliminary evidence of meeting the aforementioned requirements.

The ESPD shall be completed by the economic operators participating in the award procedure (tenderer / associated tenderer / supporting third party / subcontractor) with relevant information describing their level of similar experience and demonstrating the achievement of the required value thresholds, such as:

• the number and date of the contract invoked as similar experience / supporting document;
• the products delivered under the contract(s) must have a delivery date within the requested timeframe, namely the last 3 years calculated in relation to the deadline for the submission of tenders (in the event of a postponement of the deadline for the submission of tenders, the lower limit of the period shall be extended by the time period corresponding to the postponement, the requirement being deemed fulfilled for all operators that provided proof of completion of the similar experience contract within the newly resulted timeframe);
• the type and subject matter of the contract;
• the contract value, excluding VAT;
• the contract beneficiary; The nominated associate(s) shall each submit a separate ESPD, containing the requested information describing their level of similar experience. In the case of an association, third-party support, or subcontracting, the firm commitment, subcontracting agreement, or association agreement, as applicable, shall be submitted together with the ESPD.Supporting documents proving the fulfillment of the experience requirement assumed by completing the ESPD, namely copies of contracts / relevant parts of the contracts they have completed, recommendations, certificates of good performance, assessment certificates issued or countersigned by a contracting authority or beneficiary client, containing all the information declared in the ESPD (contract number, date, value, etc.), are to be submitted, upon the contracting authority's request, only by the tenderers whose tenders have been declared admissible. To meet the requirement regarding the level of similar experience, the following is accepted:
• either the submission of a single contract that covers the requested products through its scope;
• or the submission of a maximum of 3 distinct contracts that cover all requested products through their scope; The products delivered for the purpose of proving similar experience must represent products actually delivered within the last 3 years calculated in relation to the deadline established for the submission of tenders, in which sense appropriate evidence of their completion shall be submitted (documents showing their nature, complexity, and volume).Foreign tenderers shall submit copies of any documents confirming the delivery of similar products, accompanied by an authorized Romanian translation thereof.
