Professional/commercial register: indicate the professional/commercial register in which the company is registered or declare that the company is not obliged to be registered in a professional/commercial register. If the offer is shortlisted, at the separate request of the VS, a confirmation of the declaration (trade registration or trade registration) is required. extract from the commercial register or registration with the IHK or in the craftsman role.

Professional Association: Every company must register with the competent statutory accident insurance. It must be confirmed that the company is a member of the professional association. If the offer is shortlisted, a qualified health certificate from the professional association of the competent insurance institution must be presented at the separate request of the VS.

Professional or occupational liability insurance at a certain appropriate level: The tenderer shall declare that, in the event of the award of the contract, professional or occupational liability insurance exists or is concluded with an insurance undertaking authorised in a Member State of the European Union or a Contracting State of the Agreement on the European Economic Area throughout the term of the contract. The insurance must have at least the following coverage sums: – 2.000.000 € for personal and property damage per claim, – 1.000.000 € for property damage per claim, whereby the maximum annual compensation must be at least twice the respective coverage sum. When using subcontractors, the insurance cover must also cover the legal liability of the contractor due to selection and monitoring fault. The tenderer shall declare that the necessary insurance cover exists or is provided in the event of a successful award. At the separate request of the awarding authority, a corresponding confirmation of the insurer must be submitted. After the award of the contract, the insurance proof must be presented without request within 14 days.

appropriate references to previously executed supply and service contracts: The tenderer shall make a self-declaration indicating at least three and a maximum of five appropriate references to the services provided in the last three years or more, indicating the information required by the self-declaration. It is clarified that the bidder must submit at least three references and a maximum of five references in total, i.e. including any references from eligible companies. If more than five references are submitted, only the first five references will be considered. In order for a reference to be deemed to have been provided within the given three-year period, the reference must not have been terminated before the expiry of a period of three years before the deadline for submitting tenders (the contractual maturity with the reference provider is decisive). A reference is suitable if all the following requirements are met (references are not cumulated); i.e. each reference must individually meet the following minimum requirements: - Object of the order: UCC solution with softphone and ACD - Scope of order: at least 450 users - Performance period: System must have been in production operation for at least three months at the time of submission of the offer - Reference was provided in conformity with the contract from the point of view of the reference client The AG reserves the right to check the accuracy of the submitted references and to make inquiries with the reference providers. The personal data of the reference contractor provided by the tenderer in the reference shall be processed only for the purpose of verifying the references. Creating the appropriate conditions for obtaining and naming the personal data of the reference client is the sole responsibility of the tenderer. If reference providers do not provide a positive assessment of the reference performance, the reference shall not be taken into account. If the reference provider demonstrates that the contractor has satisfactorily fulfilled an essential requirement in the performance of the service significantly or continuously and this has led to an early termination, damages or a comparable legal consequence, the AG, as a rule after hearing the bidder, makes a prognosis decision and finally decides at its discretion whether the bidder is excluded from the proceedings. Improvement of bad references is not possible, i.e. bad references cannot be replaced by submission of better references. The references shall be entered in the list provided for this purpose. Only the references specified by the tenderer at a given point shall be taken into account. If references are given elsewhere or beyond (e.g. in general office brochures, reference lists, etc.), they are not taken into account.

Number of persons employed, number of managers: the average annual number of persons employed by the applicant/tenderer and the number of managers (owners, managing partners, managing directors, directors) of the applicant/tenderer in the last 3 years must be given.
